:innocent: Hello guys,

this tax probelm is killing me.what happened was i got married on SEP,2010.While filing tax return for 2010,i filed as single thinking that my wife is not here in USA and doesn't affect anything.i got my tax return back already(i did on turbotax,online as i always do)but recently i read one of the post here that says-"if you filed as single even you were married last year,that will be lead to visa denied."

Is that true,guys?

If it is true,what can be done???I really need your guys help here. please help.

09/10 - Wedding

09/31/10:came back to states.

10/25/10: I-130 package mailed.

11/10/10: NOA1 recieved(I130)

11/16/10: Touched.

11/18/10: I129F package mailed.

12/02/10: NOA1 recieved(I129F)

12/31/10:Touched.

Why would you file single if you are married? You had at least two options to file including married filing joint or married filing separate

You can always amend....

Also, in order to file a joint return, your wife would need to get an ITIN

Never heard of that. I think you can just refile a revised return. You should get a bigger (or even much bigger) refund.

I think the Consulate's see this pretty often. It's exactly what I did without any problem at the Consulate. I think what you read was somebody speculating. Some consulates are more picky than others, so it would help if you completed your profile. One thing you CAN do is file an amended return as Married Filing Separately. You can't do that electronically and may to require you to pay some minimal additional taxes but it won't change your "income" for your affidavit of support.

If you elect to leave it as it is for now, you can always file an amended after she arrives and has a SSN (filing married jointly), so that your 2010 return ultimately becomes "correct" and accurate.

I don't think it will make a difference in visa approval but it wouldn't hurt to put a note in your financials indicating you intend to file an amended return as soon as your spouse has an SSN. Then make sure there's plenty of evidence of a bona fide relationship. I've never heard of any Consular officer making even a comment on tax filing status, much less making any issue of it but there's a first time for everything.
