hi everyone!here's my question,my fiance filed for a k1 petition and WE do have a SON who is included in our petition.And from the time that we'll be approved,me and my son will going to apply for a visa as a k1 and k2 here in the philippines.Now,from the time of his birth his father(petitioner)is already a US citizen and signed for acknowledgement of paternity from the time of his birth(2002).and just recently we've known this CRBA application...but because its already filed this december we did not apply to CRBA anymore.

Now,does the US or Philippine consulate refuse to issue a k2 to my son?

What will happen to our k1 petition filed?

What do you think will be the process on out case?Can we go both to US at same time and it will not the cause of delays on my part as a k1 visa applicant?thanks and iam welcoming on your ideas,experiances and inputs on this.

I suggest for you to call Embassy, They know everything regarding your situation. I have 2 kids, both of my kids have CRBA and American passport since birth before my ex and I got divorced. In your situation, only the embassy can answer your query. I think both of you need visa k1 and k2 since you didn't apply his CRBA. Bt best to call Embassy.

If your baby is a US Citizen at birth, then s/he does not need a visa. You just need to file the paperwork to get a US passport for your baby. Not a K-2 visa.

hi, i'm on the IR1 Visa Category but still I think you will have to file CRBA for your son (how old is he?if he's above 18yrs they wont issue him CRBA). We filed for my daughter even though my husband didn't met the residency required (w/c is 5years). I know we won't pass the CRBA application so I asked the CO why we need it still, so he told me that it's to make sure that the child doesn't have any claim to US Citizenship. I'm sure when you get to your interview they will ask for your (denied letter of the CRBA, At least it's from my brother-in-law's experience that's why we filed last year). On the other side if your son pass the CRBA he'll be issued a US passport.

How long have your husband been living in the US? If it's 5 years up your son has a claim to US citizenship

yeah hes been a US citizen 20 yrs

if he has been physically present to the US for at least 5 years that's good news. you can't just file a US passport for you son w/out applying for a CRBA first it's kind of a package deal :unsure: , just check out the link coz there are some papers he needs to get notarized,signed etc.

i'm sure someone will come along with a better experience :blush:

Here is my two cents worth:

How old is ur son? If u apply for your son's CRBA and gets approved then he don't need to have a visa to enter the US. He only needs a US passport to come to the US. US embassy might not give him a K2 visa if he is eligible for CRBA.

You will still get a k1 visa but like u have said the son was included in the petition already? If i were u it is best to apply for your son's CRBA to get his US citizenship even before he comes here.

hi!is it ok to apply now even our petition is already filed?our we'll just wait for the consulate to find out our situation and apply afterwards?my son is 8years old now.
