Birth cirtificate needed?

I read these 2 topics and it is different from each other about birth certificate for I-130 from.

And what are the differences between IR-1 / CR-1 and K-3???? Im so confuse.

If you looked at the title of each guide, the first one is when the spouse is outside the US and the second is for when the spouse is in the US.

And the K3 visa is administratively closed. Your only option is IR-1/CR-1.

I just have several more stupid questions.

What is it saying on step 4? Does it mean I have to have my birth certificate? Or my full passport copy for sponsoring my wife from Viet Nam to US?

And what is petitioner's proof of naturalization? Like her proof of viet nam citizen?

And what is petition's residency? Like ... what?

I just have 1 more stupid question.

The US Citizen is the petitioner. The foreigner is the beneficiary. Study the actual forms and instructions in addition to the guides and study the example forms as well.

Read carefully, interpret literally and respond accurately. For some, this is too much to ask. If you're one of those, I suggest you hire a professional to assist you. We're here for remaining questions AFTER you do your homework.

This is how people do their "homework" man. If I hired a pro to assist me already, there would be no question left for you to answer. So thanks. I just have little confusing over the process, so if you dont want to answer my questions, please DONT reply at all.

IMO, it's how people avoid doing their homework. The I-130 instructions are very clear about which supporting documents are required to be submitted with a petition for a spouse. If you read carefully, you'll see the word "or" in the sentence referring to a birth certificate. Interpret the "or" literally. If you are unwilling or unable to read carefully and interpret literally, you'll never know what questions you SHOULD HAVE asked until your failure to DO your own study comes back to bite you. Know your limitations and act accordingly.

Ok, whatever, I am here to ask my questions not to argue. So just keep your philosophy for yourself ok.

And I'm here to help people have a successful immigration process. Since my extensive knowledge of the process and pitfalls tells me it's absolutely critical that petitioners study the guides, forms and form instructions, advice to do so is pretty critical stuff as well whether people LIKE hearing it or not.

The advice to "read carefully, interpret literally, and respond accurately" is some of the best that you'll get here. Yes, the paperwork process can be overwhelming; it helps to "eat the elephant a bite at at time" and review each form line-by-line and paragraph-by-paragraph. As you note, titles of documents are important, too. You may find, as I did, that the more "homework" you do, the more confidence it builds all along the way. Soon, you may be able to offer advice to others, too. Good luck, and don't feel like a stranger here.

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
