Timeline

My wife and i were denied a K1 Visa in April last year and we went ahead and got married.We Got married in May and applied for a Cr1 in October.Today we received am email from the Uscis that our returned K1 petition as expired and that the found no problem so we can go ahead and re file.Do you this this can affect our Cr1.Please your advices are very important to us.Please share what you know with me.Below is the email we received.

What was the reason they denied the K-1? you will have to know that and fix that or they can potentially deny the CR-1 for the same reason.

I am not positive but this sounds like it would be a NOID or a NOIR. They are telling you that they denied you original petition and they won't do anything with the second until you address their concerns. Hopefully you will get an answer as to why it was denied.

My opinion is they telling you that the K-1 expired and you said you were denied so you can't file to reopen your K-1 cause it has expired but you don't qualify for k-1 any more since you are now married... you have to file cr-1 but it would be good to know why your K-1 was denied so you can make sure you won't have the same problem during this process of a cr-1....

Without predjudice is good since it basically means they won't hold the K-1 petition against you. As others have asked, you should know why you were denied for the K-1 (by law the CO has to give a reason upon denial) and to correct that.

I believe you would have been told at the time you were denied? Were you not given a reason back then?

I was just told by Co that she didn't believe our relationship and that she is sending our case back for review.We have know each other for 2 and half years now.The only thing is that my wife is older than me.Apart from that,i answered all questions and had all the needed evidence.My wife visited me again last year after i was denied and will be visiting this year before my Cr1 and will go with me to the embassy.
