I already messed up - forgot copies of divorce papers

My gut told me to triple check. I did not. I Expressed Mailed my I-129F this afternoon and then went to have a beer to celebrate. Looking over my checklist over my beer, I realized I forgot the copies of the divorce decree.

I feel like...well, you know what...

Can I Express Mail the copies with a letter and some type of indication in bold print on the outside of the Express Mail so that it can be put with my I-129F quickly so it is not delayed?

I feel so so bad...

Please help me. Thanks,

tom

It's very unlikely that they'll add the missing document to your petition, even more so because you don't have a receipt number. Wait for the RFE and then send it express mail.

I only offer advice - not even legal. Just the plain and simple kind.

If you send something now there's no way for them to match it up with the rest of your file... I'm afraid you'll have to wait for the inevitable RFE and THEN send it off.

Karen - Melbourne, Australia/John - Florida, USA

- Proposal (20 August 2000) to marriage (19 December 2004) - 4 years, 3 months, 25 days (1,578 days)

STAGE 2A - Arriving in US (4 Nov 2004) to AOS Application (16 April 2005) - 5 months, 13 days (164 days)

STAGE 2B - Applying for AOS to GC Approval - 9 months, 4 days (279 days)

STAGE 3 - Lifting Conditions. Filing (19 Dec 2007) to Approval (December 11 2008)

gosh, i cannot believe i did this. i feel so so sick!! how long will it take to get the RFE?

tom

Hard to say. However, I am convinced that RFE's garner immediate attention to your case. In my case, I was approved within weeks of the RFE.

Unfortunately, other March buddies here still wait.

Don't worry about it.

Try not to stress about it. A RFE doesn't mean you'll have to wait months extra - when they come to process your file they'll see that 'something is missing' and send the RFE to you. Since you already KNOW what's missing you can have it all ready to send it to them the same day that the request arrives! It'll probably only add a week to your visa, and that's really not enough time to have a nervous breakdown over... we had TWO RFEs, and the initial processing for the visa was still done much faster than I expected it to be - I expected it to take six months from when NOA1 arrived, and it only took three.

William, you should say that you were approved within weeks of your second RFE.

Although it would calm down the OP, I don't think we can really say how longer it'll take for them to send the RFE out or how long it'll take them to process it. I guess when you filed, things were a lot different from what they are know. In any case, there's no point in worrying about it now. The only thing that can be done is wait for the RFE and send the documents ASAP.

Yeah, good point mrc. I am still thinking IMBRA RFE for everyone. Apparently, they have finally gotten over that #######. The second RFE was the kicker.

Thanks Dude.

When you receive the RFE and return it with the missing document(s), write "RFE" with your case number on the outside of the envelope. Not sure whether it will help or not, but it might.

8-30-05 Met David at a restaurant in Germany

3-28-06 David 'officially' proposed

4-26-06 I-129F mailed

9-25-06 Interview: APPROVED!

10-16-06 Flt to US, POE Detroit

11-5-06 Married

7-2-07 Green card received

9-12-08 Filed for divorce

12-5-08 Court hearing - divorce final

A great marriage is not when the "perfect couple" comes together.

It is when an imperfect couple learns to enjoy their differences.

Oh, it helps for sure. Living proof here.

Be sure to write it like this: ATTN:RFE In red marker, front and back.

This is the identical information from the USCIS supplied envelope, in red ink.

You will need to send in multiple pages that don't fit well in a normal letter sized envelope, so you may want to send it USPS Express. It also arrives very quickly. This is the way to go.

Good call JenT.

Well in my case it did happen. I had filed through lawyer. I forgot to send some of the docs. I called and she told that the case is already gone. I said what abt the missing docs. She said we can send it later on. Yes it did happen that we sent our case in two parts. So listen in my point of view you do this thing:

First send the sopies of the div decree alongwith the explaining letter(notairzed that its the part of the so & so application, date###)

If they accept it great, no harm in doing it.

If they send an RFE then it wont be a surprise to you.

So do what you can do and rest leave it upon them what is their reaction to it.

It's very unlikely that they'll add the missing document to your petition, even more so because you don't have a receipt number. Wait for the RFE and then send it express mail.

In my case, I didn't send a certified copy of the final divorce decree signed by the judge, so I got an RFE for just that. I sent what they asked for and they approved my petition within a few days of receipt of the certified decree. don't sweat the small stuff. It was IMBRA that screwed my petition up, not the divorce decree. Even with that RFE, and not counting the 4 month IMBRA delay, my petition was originally approved in less than 30 days at NSC. B)
