Starting I130 Visa for Spouse

Hello This website and form has been so helpful, I have started on the form and even visited the USA EMBASSY

I have a lot questions, which hopefully will make sense.

My spouse and I we married last year in the state of Texas using Proxy(stand in)for marriage since he is not the USA and has never been here.

We are now together for just a few months in Malaysia. I am on a 3 month visa and he is on a student visa for the next 2 months. When he sent his paper work it was from Malaysia but our Texas marriage license does not say anything about malaysia, and the court took that paper work. He will leave Malaysia for the middle east and I will go back to America.

I want to interview in USA and he wants to interview in Middle East what options do we have? For line #8

I want to send the paper work now to the USA for process. For the interview to be in the USA for me and Middle east for him. When filling out the I130 number 8. ask for date a place of marriage. Is that Texas? or Both Malaysia and Texas? We are not legally married in Malaysia. Can I just put texas? We can get legally married here, but we are not here for a long time. I went to the USA Embassy in Malaysia and they where not helpful and rude. I may have to go back just to have my questions answered. We can not fly back here just to be interviewed.

Also I was thinking about just starting the paper work here and make payment here in malaysia, but not be interviewed here is that possible?

Can I fill the paperwork out in both ink and by typing some names and places do not fit in the boxs? Or just one ink or typing?

Can I make payment by check from family member?

Timeline

The interview for the immigrant visa will take place in the country where the beneficiary is a legal resident or citizen. You cannot have him interview in the US. It is unlikly, but not unheard of, that the USC will be interviewed

For your marriage part, I would explain what happened as proxy marriages are not recognized in the US until the couple has met in person. Make this proces easy for yourself and explain the proxy marriage in TX and supply proof of having met after the proxy marriage

Type what you can, write in what won't fit on the form

Timeline

USC not need any interview , unless specifically told so by USCIS, between I-130 submittal and approval dates.

The cool things about proxy marriages is that ONCE the marriage has been consummated, prior to US Embassy interview, yer golden.

Thank you both so much. I have mailed the packet for I-130 and am waiting to figure out the next step. We have completed our marriage and have had our honeymoon. Looking forward to the next step :)
