Marrying a british citizen In canada

Hello all, I am new to this site and been reading alot lately.. thank you all for who contribute here.

I am going to marry my fiancee' who is a british citizen but lives in canada for the past three four years. Her whole family lives there and she does work full time there. Her work permit is expired now though eventhough she is still with the same employer. If I marry her in Canada and hten file for her to come to the US, does her statust in canada matter?

Not really, no except she will need a police report from Canada before the interview. To the extent her status would impact obtaining that report, it matters but the US is not concerned about whether she overstays her welcome in Canada or works there without authorization.

If she gets a police clearance from England woudl that work even though she is in canada.. or does she need one from canada? Is it possible to get one in canada for someone who is not a canadian resident but lives there.

She'll need one from any country in which she spent 6 months or more since reaching the age of 16. The HOW can be found here. http://travel.state.gov/visa/fees/fees_3272.html

we are getting married in canada, almost everything will be in canada including the address marriage..

Can't figure out what part of any of my posts you're not understanding. Police clearance will be needed for Canada and England but those come months into the process. Check the link I gave you for how those are obtained and see if YOU see any problem.

Can't figure out what part of any of my posts you're not understanding. Police clearance will be needed for Canada and England but those come months into the process. Check the link I gave you for how those are obtained and see if YOU see any problem.

sorry if it seems I am asking the same thing. my whole worry is that if she is not a legal resident in Canada anymore should I apply for her using her UK's address and she can go to the counsalte there to get her immigrant Visa. Offcourse its better if Its done in Canada but I don't wanna screw up my chances.

I have been doing homework and asking questions here is part of the homework, The linkg you sent me is usefull no doubt but it doesnt answer questions like I have and I am just exploring my options and to see If there is anyone that have a similiar situation int he past that I can learn form.

Then read my answers again. There are four pieces of information you need.

1. The US doesn't care about her status in Canada as long as she can provide the police report.

2. The police report can be requested as indicated in the link I gave you by persons physically present in Canada

3. She can interview for the visa in her country of citizenship or country of residence.

4. She now lives in Canada

If you have remaining questions, ask them clearly.

When she applies for a Canadian police (RCMP) certificate, she will need to show an ID, usually a province-issued ID (driver's license, provincial ID). Does she have a valid ID she can show the RCMP?

You (or she) needs to go to the US Consulate (Montreal, I think, is the only one processing spousal US visas in Canada. Please check to confirm.) website and check their procedure/requirements. As she is neither a Canadian citizen nor landed immigrant, she must be able to legally remain in Canada for at least 6 mos. This means that she must be able to provide proof of status (e.g., study permit, work permit).

Since your fiancee has no proof of status in Canada, she'll have to use her UK address and return to the UK for her interview.

Additionally, you'll also have to consider that if your fiancee is going to use her UK address, then the NVC is going to handle her CR1 visa application as coming from the UK. Consequently, she will be required to submit a fingerprint-based RCMP certificate. Check the RCMP website for requirements/fees for getting their certificates. There are two different procedures - one for those residing in Canada (no fingerprints) and one for those outside Canada (with fingerprints).
