Removing conditional status on 2 year green card

Hello,

Here is my situation. My stepdaughter (14 years old) and wifes 2 year conditional green cards expire the end of July 2011. My stepdaughter wishes to travel back to her old country to spend time with friends and family during the summer break from school. This means she wants to be gone from mid June to the end of August. Is this possible with her green card expiring the end of July ??

I have looked at the instructions for I-751 and it shows when providing initial evidence, for sending in the form you must provide a copy front and back of the conditional green cards, 2 passport style photo’s for each applicant, and 2 completed fingerprint cards (Form FD-258) again for each applicant.

I am having trouble finding form FD-258 and not able to get much help from USCIS. I basically am just trying to put everything together so the daughter does not need to be here through most of the process. The idea is that she can travel after I get all the required forms, documents etc. from her.

I read someplace where once they receive the I-751 application the applicants will receive temporary extension green cards as you can only file the I-751 90 days prior to expiration. I could then mail her the new green card with the extension so she can re-enter the US. Most likely appointments etc. would be after she returns. This is based on the time frames it took us during the AOS process to even get the 2 year green cards.

Reading some of the other postings it kind of seems like maybe you really don’t send in the FD-258 form along with the I-751 but wait until they instruct you to go for biometric processing and then that is when they obtain form FD-258 ?? Yes No? If not how do you get the FD-258 forms?

If there is anybody out there with any helpful information I would really appreciate it. Thank You. Jerry

No photos or fingerprinting cards needed - only if you're in military and overseas would this apply to you.

If you file exatcly 90 or 89 days before the expiration of their green cards you should be able to get the receipts within 3 weeks. This receipt serves as extension of green card for a year and with that and the expired green card they're able to travel and return to the US>
