Hello,

My fiances k-1 visa interview is in less than a week, and he is getting extremely nervous that they are not going to treat him fairly and that they could deny him for any little reason just because they are having a bad day or whatever. He is worried that they are going to treat him differently because they are from the US and he is from South America.

My opinion is completely different because we sent in a ton of proof of our relationship, we havent gotten any RFE's, I will be with him at the interview, and I assume I can sit right in during the interview which would mean they would not be able to just randomly treat him unfairly. But if anyone can give us any advice or words of encouragement or anyone who did feel that they were treated unfairly during thier interview, I would really appreciate it so I can show him and calm his nerves! THANK YOU!

5-27-2011 -- (day 56) I485 Card Production ordered!!!

6-02-2011 -- (day 62) Welcome Letter Received

6-03-2011 -- (day 63) Green Card and EAD/AP Cards RECEIVED!!!

Done with Immigration for TWO WHOLE YEARS!!!

First of all, congratulations on your upcoming interview. It will be good that the two of you will be able to attend. Make sure you bring all potential proof of your relationship with you and don't forget the affidavit of support, too. Dress business casual, and try to rest up the day prior to the interview. Be calm, honest, and professional; treat it as a job interview. In fact, as the most important interview you have had in your life!

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

I assume you're going to Buenos Aires embassy.. it is intimidating at first with all the security and such but it's really not a scary place. Those people are people who chose to work in the embassy, some of the women told me they had done the same K-1 visa with their Argentine fiance but now had come back to spend some time there and are working trying to help others immigrate legally. The people working there live in Argentina and although they may not be Argentine they chose to do it for a reason, they might have friends or family there to visit or love the culture or want to get better at Spanish or whatever. Everyone is nervous, but the embassy employees are on your side, they're people too, they're just doing their best to uphold the rules so that everyone is treated fairly and US security standards and laws are enforced properly while making it a welcoming place to all good-intentioned people.

Read the embassy reviews, it actually helped us a lot before the interview to realize that them running hours late and getting confused and just being real people meant it wasn't such a scary thing. We went in SO nervous, but after hours being there just started to understand it was just something to do, and be honest about, and stand up for yourself in a polite way, and to be prepared for, but not to be scared of- if you don't have anything to hide, there's no reason you need to be sweating the armpits off your sweater! Just try to relax.. if they're running really behind, maybe even take a nap or get to know some of the others waiting.

You should know too that as a US Citizen there you definitely have rights and can advocate on behalf of yourself and your fiance.. but there generally won't be a need to do this- we used this sort of power to beg for them to process faster or give us more information, and most of the time their response was "we'll do our best".

It helped us to know we were going to have a treat after the interview- when you can tell yourself "no matter what happens, we're going to go together to our favorite restaurant and get ice cream and take the rest of the day off, and we'll have each other there for support" through your nerves getting the best of you, it can make you feel a lot better!

05-18-10 delivered packet to embassy

embassy asks us for ridiculous things before giving interview date, such as a photocopy of the sealed envelope from the medical exam...

07-27-10 interview

08-05-10 received visa!!!!!

08-06-10 left Argentina

08-07-10 POE (Dallas)

08-12-10 civil marriage ceremony

08-23-10 mailed AOS packet with EAD and AP applications together

08-25-10 packet arrived in Chicago

09-01-10 NOAs

09-02-10 check cashed

09-21-10 received SS number :) had to go into office twice but it worked!

09-23-10 requested EAD expedite

09-24-10 received biometrics letter

09-27-10 successful walk-in biometrics taken

10-01-10 receive EAD expedite request RFE letter

10-04-10 US Representative's office forwards our EAD expedite evidence

10-06-10 expedite for EAD granted, EAD and AP both issued :D

10-09-10 wedding (party!)

01-04-11 AOS interview (rescheduled because we moved, was 12-16-10) Approved!

06-04-2007 = TSC stamps postal return-receipt for I-129f.

06-11-2007 = NOA1 date (unknown to me).

07-20-2007 = Phoned Immigration Officer; got WAC#; where's NOA1?

09-25-2007 = Touch (first-ever).

09-28-2007 = NOA1, 23 days after their 45-day promise to send it (grrrr).

10-20 & 11-14-2007 = Phoned ImmOffs; "still pending."

12-11-2007 = 180 days; file is "between workstations, may be early Jan."; touches 12/11 & 12/12.

12-18-2007 = Call; file is with Division 9 ofcr. (bckgrnd check); e-prompt to shake it; touch.

12-19-2007 = NOA2 by e-mail & web, dated 12-18-07 (187 days; 201 per VJ); in mail 12/24/07.

01-09-2008 = File from USCIS to NVC, 1-4-08; NVC creates file, 1/15/08; to consulate 1/16/08.

01-23-2008 = Consulate gets file; outdated Packet 4 mailed to fiancee 1/27/08; rec'd 3/3/08.

04-29-2008 = Fiancee's 4-min. consular interview, 8:30 a.m.; much evidence brought but not allowed to be presented (consul: "More proof! Second interview! Bring your fiance!").

05-05-2008 = Infuriating $12 call to non-English-speaking consulate appointment-setter.

05-06-2008 = Better $12 call to English-speaker; "joint" interview date 6/30/08 (my selection).

06-30-2008 = Stokes Interrogations w/Ecuadorian (not USC); "wait 2 weeks; we'll mail her."

07-2008 = Daily calls to DOS: "currently processing"; 8/05 = Phoned consulate, got Section Chief; wrote him.

08-07-08 = E-mail from consulate, promising to issue visa "as soon as we get her passport" (on 8/12, per DHL).

08-27-08 = Phoned consulate (they "couldn't find" our file); visa DHL'd 8/28; in hand 9/1; through POE on 10/9 with NO hassles(!).
