I-134 Real Estate & Mortgage Question

I'm hoping someone can assist me. We just received our NOA2 today and I'm completing the I-134. Here's my circumstance- I make a pretty decent annual income ($80k-$100k)but I don't have a ton of assets- I have a 401k with $20k in it and I have cash in a bank account of another $20k as well as personal property of another $20k. Here's what I need help on:

I live in a two family apartment and my mom lives downstairs and owns the house and I live upstairs. Along with working full time I am also her main caregiver. Some years ago I assumed a mortgage on the property with my mom cosigning. The purpose was to buy some adjoining land and also paid off some credit card debt etc. So long story short- I have a $160k mortgage where I am the borrower and my mom the coborrower but the asset (the house) is in my mom's name only.

I know I am all set on the income side but I just want reassurance and guidance on how to disclose the mortgage issue without the offsetting asset.

Any help is greatly appreciated.

You don't need to tell them about the mortgage. If you had a low income and owned real estate which you were going to use as an asset, then you would have to disclose the mortgage on it. But as you do not need to use assets, and don't own the house, there is no need to mention it. Your income is sufficient.

I agree with JoannaV...you don't need to add assets, you make more than enough to be the main sponser. And I DOUBT you'll need to mention your mortgage. All they want to know is that you're able to support your household.

As long as your income is over the limit for the I-134, the house doesn't mean anything. Based on your post, you're all set.

(I'm going for the IR-1 and blowing off the K-3. Even if it takes an extra couple months, it's worth it to not have to deal with USCIS again)

Note:

Please fill out I-130, wait 6 months for approval, then 3 more months for an interview. (Unless of course we've bombed your country into the stone age, then you qualify for expedited processing.)

Ok, so I leave out the mortgage entirely. They are not pulling a credit report I assume so no issue there? As far as I can tell the only documentation evidence needed is for the 401k? I'm not self-employed so they don't need anything to substantiate my income? Don't they verify any of this stuff?

You don't need to worry about 401k either. Just list your income. The K1 guide talks about what you should include w/ your I-134.
