travelling out of country after filing

Timeline

Hi all, back on VJ after 2 years. I am in a weird situation when my wife's I-751 filing date is due eligible from 15th January but we will be flying out on Feb 3rd for a month out of country. By seeing the BImetrics average timeline looks to be 30days. This means if i file by 15th than we would get a mail for appointment around mid to late february which we will probably miss. I read somewhere people trying to do walk in after there biometrics appointment has passed but within 90 days timeline, some were lucky to get fingerprinting done. But some were having hardtime getting 2nd appointment. Does it worth the risk or should i have this mailed around the time we leave on Feb 3rd and hope to get the biometrics app around the time we get back which is March 6th. Or is there any other better alternative that some1 knows about or gone through. Thanks for answers and good luck to everyone.

From what I have read so far, it seems to be possible to request another biometrics appointment on another date if you cannot make the first one for some reason.

But, and let me first say that I, of course, don't know your situation, isn't it a bit unwise to leave the country at this point? I mean, if you file around the 15th then you might not see the NOA1 come in by mail and, if for some reason, something goes wrong when you send the petition out, then you might not find out until you actually come back again. This would be late februari/early march, I think? Then you already lost almost 2 months out of the 3 in which you could file the petition. I mean, it is taking risks, if things go wrong (and remember, you still have to deal with some postal service), they might actually say at one point that they never received it on time. Or what to think if something happens to your wife while being out of the country.. if she cannot be back in time, it might cause other problems at re-entry. Although these things probably wont happen, you'll never know so please be aware of them anyways :)

02/06/12 - Received yellow letter (pre-interview case file review)

03/13/12 - Placed in line for interview scheduling (3 yr anniversary)

04/17/12 - Interview - No decision, application under further review

04/17/12 - Biometrics

04/25/12 - Placed in line for oath scheduling (so I'm approved yay!)

04/27/12 - Received oath ceremony date

you can't do a walk in without the asc appointment letter for biometrics,thay send you away,you send the 1-751 about 8 days later you get a noa1 receipt,one year extension,next about 12 days later you should be getting the biometrics appointment letter,about three weeks later,if you want to cancel your appointment the information is on the appointment letter, what you have to do,

I would send it out the day you leave. The chance of them scheduling biometrics before you return is low. Why not have somebody monitor your mail and if you get an appt before you're scheduled to return, cut your trip short.

I'm in the same boat as you was just going to ask the same question of what the average time is from sending in the application to getting a biometric date. Hopefully not needing an interview.

You said your wifes ROC window starts around January 15th. It seems to me your wife's green card expires mid March. You will be back by March 3rd so why don't you mail the package when you come back? Or have a trusted friend or relative mail the package in mid february so the NOA 1 will be waiting for you when you get home. The biometrics will follow later and you won't have to reschedule anything.

That is exactly what I have planned to do. I will have the office secretary mail it out on 15th Feb. By the way the green card expires on 15th April and window starts 90 days before which is 90 days from best of my knowledge. Thanks for your advise, this confirms my step.

By looking at the general trend at VJ it seems the biometric appointment is 30-40 days from mailing the I-751. Good luck to you.

Doing that should be enough I think, it is probably the most safest to do... and yeah, I can understand the importance, I would go too in that situation :)

I also have a similar question, we are actually at the end of our 90 day window I am submitting my husband's lifting conditions hopefully tomorrow (they need them by 1/29/11). However, we are planning a trip to see his family for 2 weeks in March and I doubt we'll have the new greencard by then, is the NOA1 enough since it technically extends his greencard an extra year? By this I mean would we be ok for re-entry into the US with his expired greencard and a NOA1?

Yes. My wife's greencard expired in December. We filed in October but she didn't get her new one yet. She's traveling abroad this weekend and she's taking the letter (I-751 receipt) along with her expired greencard.
