Timeline

I have filed my AOS and just did biometrics on dec. but my I-130 was supposed to be approved (family based-naturalized mother) over 4 years ago but we didn't know and they never sent any approval letter and when my mother finally made an appointment to check the status they said they didn't have an recent address for us (BS!) so we sent our AOS application on Nov. but my question is, once i receive my GC can I apply for citizenship since technically I was supposed to have my GC 4 years ago?

The reason i ask is because my cousin's aunt had the same issue and she applied for citizenship the same year she got her GC and was approved.

Unfortunately, no.

In order to become a US citizen the same time your mother became one through naturalization, you needed to be a lawful permanent resident, even if it was just for 1 day, the moment that happened. Yet you are not even an LPR now, and the fact that your AOS application has been running for so long doesn't change that. Hence, you'll have to wait another 5 years after becoming a resident until you can file for naturalization on your own.

There is no room in this country for hyphenated Americanism. When I refer to hyphenated Americans, I do not refer to naturalized Americans. Some of the very best Americans I have ever known were naturalized Americans, Americans born abroad. But a hyphenated American is not an American at all . . . . filed I-130 march 2003 and never heard of anything else until naturalized mother made an appointment on June of 2010 that our application was approved a long time ago but they never sent us an letter stating that no current address was found. I just want to know if the time my I-130 was approved counts (since they were the ones at fault for not sending approval notice) so i can apply for citizenship on i get my GC.

Make an Infopass appointment and speak to an Immigration Officer, take all documents you have regarding your case and they will be better able to advise you on what to do and where you stand and what your next step should be. You can make the appointment online. Good luck.

Hi, this like what happend to me,

My wife filed my I-130 on 2004, this when i was in my country before i come to USA. on K-3 Visa (I-129F) and since then i never heard anything about that Case, i made alot of calls and Infopass but with no help. i came to to USA then i wanted to get My Green card but no way i was told i have to wait for my I-130 to be approved. So, after load of calls and Infopass, and after 2 Years in USA they found my I-130 on the warehouse, they send it accidently to the warehouse, but i dint listen to them i filed for my Green Card, got my Interview, Got Approved, Got my Green Card. with no problem, before that they had to bring my I-130 to my local office and i guess he approved it the same day i went to my Interview. and since 2004 till now i never received Approval notice on this I-130. but when i called i was told Yes ur I-130 had been Approved and if i need a copy i have to pay for it. so i no need to pay for something i dont want it now.

i know its their fault but u cant tell them that, u know the USCIS.

Dont worry just explain ur case to the IO. and God willing u will be fine.

My N-400 timeline, I hope it will help - Local Office (Chula Vista Field Office - San Diego)

10/01/2010: Application was sent.

10/04/2010: Application was received.

10/06/2010: Email received "Application has been received" & Noticed Date.

10/07/2010: "Touch"

10/08/2010: "Touch" & Check was Cashed

10/09/2010: NOA1 Received via mail.

10/22/2010: Status Changed Online "Request for evidence" It was for Biometrics.

10/25/2010: Request for evidence recieved "Biometrics Notice".

11/18/2010: Biometrics date ==> 11:00AM. Biometrics was taken On time.

12/03/2010: "Yellow Letter" Received.

12/06/2010: "Touch" Case Moved to "Testing and Interview".

12/08/2010: Interview Letter received via mail.

01/13/2011: Interview Date. Done, " Thanks To ALLAH, I Passed the Test.

01/18/2011: Oath Letter was Sent.

01/20/2011: Oath Letter Recieved via mail.

01/28/2011: Oath Date. ==> Done, I am a U.S. Citizen

01/31/2011: Applied for a U.S. Passport Book, And, U.S. Passport Card.

02/25/2011: Passport Book's Received.

02/26/2011: Passport Card's Received.

02/28/2011: Certificate Of Naturalization's Returned.

Same with my stepdaughter, USCIS misplaced her application, but found it. But instead of dating her card when they lost it, dated it when they found it, some two months later.

Then I had a good immigration attorney that put pressure on them, but ironically, he didn't want anything to do with the I-751 and the N-400, good thing for him, got a flat fee, and he had to do a lot of extra free work. He suggested I contact my senators office that I did and we filed ourselves for ROC and citizenship.

Kind of reminds me of that Jerry Lee song, A Whole lot of shaken going on, but replace shaken with misplacing. For us, AOS, I-751, and the N-400 oath letter was misplaced.

Got an e-mail from the lockbox that my stepdaughters N-400 was forwarded to our local field office, hope that doesn't get, "misplaced". Would be nice if the IRS would misplace our W-2's and 1099's so we won't have to pay taxes, but so far, they are batting a thousand.

That's what i was thinking too, they must have misplaced it and don't want to admit to it. My only problem is that I could have done so much if I had my GC 4 years ago and could now apply for jobs that require citizenship by instead of waiting for my AOS I could be waiting for my naturalization application. :angry:

Once I get my GC I will schedule an Infopass and try to maybe apply for my naturalization but who knows? maybe I'll get it!

You will be able to apply for US Citizenship 5 years from the DATE on the green card that reads " resident since."
