You must get the Affidavit in lieu of a Certificate of Legal Capacity to Contract Marriage." A U.S. citizen may execute this affidavit at the American Embassy in Manila

.

Any foreigner who wishes to marry in the Philippines is required by the Philippine Government to obtain from his/her Embassy a "Certificate of Legal Capacity to Contract Marriage" before filing an application for a marriage license. I married my wife in the PI, It's not hard if you follow the directions.

To get this you need to go the Embassy web site to get a appointment to do this also. It's no longer first come bases you have to a appointment to get your certificate of legal capacity to contract marriage and the cost is 50.00 us dollars to do this.

We did it within THREE (3) days. I was there 10 days, but on the 3rd day we were already married. We planned ahead.

1. My wife got the marriage application form from City Hall in Quezon City where she lived.

2. She filled out her part, and then sent it to me via regular mail so that I would have the original.

3. I filled out my part, then went to the bank and got it notarized.

4. I then went to the County Clerk's office, and had it certified.

5. I mailed the application to Department of State for the state of Tennessee where I live and had it authenticated. Then they mailed it back to me in a self enclosed envelope.

6. I sent it to the Philippines Embassy in Washington D.C., the embassy that represents my area of the USA, to their consulate, and they did their stuff with it, authentication again I guess, it has been a while and am forgetting what you call all of it. But the procedures you can find online. Anyway, they mailed it back in a self-enclosed envelope again.

7. I mailed it back to my wife, along with a passport photo of me, and she brought it back to City Hall, and they displayed it the required 2 weeks.

8. I flew to the Philippines. On my 2nd day there we went to the US Embassy in Manila and I got the Legal Capacity to Marry paper.

9. The same day we went to City Hall in Manila, and my wife spoke with the clerk and made the final arrangements.

10. On the 3rd day we went back to City Hall, and met with a judge who performed the ceremony, and we were married that same day.

We did NOT have to attend the marriage counseling because of our age. She was 34 at the time and I was 47. That was in 2008.

How many days po bago mairelease yung legal capacity to get married?..let's say we will go to US Embassy on May 30 at 1pm, within the same day mairelease rin ba? and how many days u need in setting up an appointment? thanks for the reply...

The legal capacity to marry document is given to you right there and then at the time of your appointment. You'll have to pay $50 or peso equivalent.

Make sure to thoroughly read instructions on how to book your appointment by going to this website http://manila.usembassy.gov/marriage.html When booking your appointment, include a valid phone number where USC can be reached in case they cancel or reschedule your appointment.

US Citizen will need certified copy of final divorce decree and US passport. I am in the process of petitioning my pinoy hubby and I wasn't required to obtain a CENOMAR. My pinoy hubby did have to provide one. The whole process of obtaining Legal Capacity to Marry took about 30 minutes. You'll be sworn in by CO and she signs the document and hands it to USC and you're done.

Hope this helps

You don't need to set an appointment sa USEM. Go to the USEM as early as 8:00AM and your legal capacity will be released mga after lunch. Pasyal ka muna sa Robinson Manila :). That's what we did. Also, true you need to wait for 10 days to have a date of your marriage whereas kami we did not. We do it the other way around pero legal. What province ka ba? Me kasi from QC, and I was able to help a friend din with the same situation.

If you're asking about USC getting married in PI. yeah he needs to get that affidavit ( legal capacity to marry) from USEM you need to book an appointment through their website and here's the link http://manila.usembassy.gov/marriage.html

You can't just go there and get an affidavit without setting up an appointment first, if the USC have the appointment on May 30th 1pm one or both of you can go to USEM to have it and after a brief interview to USC from an officer inside, it'll be quick, the affidavit will be handed the same day USC just have to pay the fee for it if I can remember my husband paid more than 50$. Good luck!!!

We married 8 days after my husband came to Manila. It would have been sooner if he didn't come on Friday night. We (actually, I) started the marriage license application before he came. It's not "not an easy task" as long as you know what you're doing and you have all the requirements needed to get the task done.

You can actually get married in Philippines within 2 days. It took us 3 days though because of arriving in Philippines early Sunday morning.
