Outside the US before applying for citizenship

Hi VJ friends..

I have a quick question.

I am eligable to apply for citizenship next month. but I made a 3 weeks overseas trip last month. so, do I have to wait for 03 more months from the day I returned to US.

Please Advice me.

If you have never been longer than 6 months outside the USA since you became a resident, you can file as early as 90 days before the 3rd anniversary of your Green Card. No need to wait longer.

This is only the case if married to US citizen the entire 3 years.

And no time out of country does not push back the time that you can file the N-400.

You can file it within 90 days before 3 years (Married to US Cit) or 5 years (Not married to a US Cit) of LPR status. Thats 90 days, NOT 3 months, 90 days is shorter than 3 months.

The requirement is to have lived in the State you are living in and applying from at least 3 months prior to applying for Naturalization. A 3 week vacation out of the US does not interrupt your 3 month residency in the State. You maintained a residence, a job, all of your physical belongings in the State while you were temporarily away. You did not stop living in that State, so you can apply for Naturalization when you reach 5 years minus 90 days as a Permanent Resident. Good luck.

I believe you mean staying for longer than 6 months outside of the USA for each trip. In the example of being married to a USC, You are allowed to have multiple 5 month trips outside of the US, so long as you do not exceed the 180 day physical presence requirement for the prior 3 years.

05-06-08 Visa received in mail

07-28-08 Wedding Date (Reception was 26th, but forgot to reigster for MC...oops)

10-04-08 Applied for AOS (EAD and AP also)

10-09-08 NOA1 for I-485

10-27-08 I-485 transferred to CSC

11-04-08 I-485 Biometrics appointment

11-13-08 NOA1 for EAD

12-09-08 EAD Biometrics appointment

01-08-09 AP Approved

01-13-09 AP Received

Cost of 3 roundtrip tickets to Brazil in last 3 years...... $2,900+
