Guess what happened....... lost in the mail. So today I sent it out agian today.

Umm, I guess it's been established by many VJers's experience that calling them doesn't actually make a difference.

OP: Your fiance can try to enter the U.S., but I guess you're aware that she could be denied entry. So... don't put too much hope on it.

Also, I read on another thread that your RFE was lost in the mail and you didn't have a copy of it. What did you do to solve this situation? EDIT: You've answered this question above :)

No she's going to try to move here.

But how exactly do you guys plan on having her move to the U.S.? She'd try and use a laser visa? And then what? Withdraw the K-1 and try and adjust status if you get married - which would be ilegal, btw, because then she'd have intent to immigrate prior to going there?

Once they receive the info for this RFE, I'd give it some time and if you still hear nothing, it may be time to call your congressman or senator (if you haven't already).

Wow - your nightmare continues. How did you get another copy of your RFE? Did you fed ex it? I would think/hope/pray that your approval is around the corner - what happened with your expedite request?

I guess the big worry is that if she comes on a tourist visa (assuming she already has one b/c the wait for an appointment is 143 days right now) then what will you do? Will she just visit until the approval and then go back for the interview?

I've call my congressman's offices many time and found that they are as helpful as the USCIS customer service

That's what worries me I didn't get another copy of my RFE, I just sent in a letter explaining that is was lost in the mail. I did send in my Decree of dissolution of marrige. We'll see what happens, but I already think that they won't except it and I'll have to wait for them to send out another RFE.

I thought in Mexico you did not need an appointment

I don't know of any country where you don't need an appointment to apply for a tourist visa. In Mexico, as of August 22, wait time for an appointment is 143 days. Processing time is another 30 days after approval. The application fee is $100. More information here:

http://mexico.usembassy.gov/mexico/evisas.html

Might be worth it to follow up on the expedite request - aren't they required to respond to the congressman regarding the status of the request? Really, given that the bulk of your delay was due to USCIS error, I can't understand how they could possibly deny the request!
