K1 visa holder and state based health care

Here's the scoop. My buddy who lives in Wisconsin with his K1 spouse was able to get his spouse on a state based health care costing him nothing. I'm just afraid that he may be breaching his affidavit of support. Can anyone shine some light on this issue? I do apologize if this topic has been discussed. Thanks everyone!

08/05/2009 - Landed in VTE and greeted her at the airport.

09/02/2009 - Landed in MSP and started paperwork.

09/14/2009 - Sent in I-129F Petition for Alien Fiancee.

09/16/2009 - NOA1 Date.

09/21/2009 - NOA1 Hard copy received.

11/02/2009 - TOUCHED!

12/15/2009 - 129f Approval Notice!

12/22/2009 - NVC - IN

12/24/2009 - NVC - OUT

12/30/2009 - Embassy Received - Called Fiancee

01/06/2010 - Medical Done

06/21/2010 - Interview - APPROVED!

06/23/2010 - Visa in HAND!

06/27/2010 - POE - MSP!

11/01/2010 - Mailed AOS Packet

11/02/2010 - Delivered

11/15/2010 - NOA1

12/08/2010 - Biometrics Appointment

01/11/2011 - Perm. Resident Card (Conditional) ordered. - That was fast...

His agreement is with the FEDERAL government. Not the state. If it is a state program there is no violation. Bear in mind that many "state" programs are actually "state run Federal programs" She is not eligible for medicaid, for example, not only because of the I-864 but also because of a 5 year qualification rule for permanent residents. If he DID get her covered by a federal FUNDED program, then he did so by fraud or they gave her the coverage in error.

Every state runs their medicaid programs differently. In some cases the immigrant can qualify.

And Medicaid is never a "state run Federal program". Federal dollars are funneled into many Medicaid programs, but the States run them. And the states make the rules about who can and cannot be assisted.

Besides, we don't even know what program this woman qualified for. It might not be Medicaid.
