Timeline

Hi to all,

My friend is asking for help, she is married to a UC and he s filling the I130 for her, her husband got the US citizenship last juin, and they have a baby who was born 2 yrs ago from the date he had his citizenship, exatly on October 2008, can the father still fill for his baby to get the american passport or is it too late now and had to do the I130 for the baby too..?

07-15-2010: I-130 package mailed.

07-21-2010: Received NOA1 hard copy.

11-02-2010: Case transfered from CSC to TSC

11-03-2010: Updated

11-04-2010: Updated

11-24-2010: Updated (Case transfered to a USCIS office !!!)

02/09/2011: Updated

02/11/2011: Updated

02/22/2011: Approved

03/10/2011: Case number assigned

03/14/2011: Email of the DS-3032 form

No, the father will have to submit another I-130 for the child. He hasn't been a USC for 5 years and for that reason he can't get the child US citizenship.

Correct, however as soon as child enters the USA on the IR-2/CR-2 visa, at this point father can file an N-600 and claim US citizenship.

Do you mean that in order to get the citizenship for the baby, the father should be a UC on the same day the baby was born ??

I read it to mean that the baby will be entitled to claim his US citizenship as soon as he becomes resident in the US.

Here is the link to the Casa Blanca consulate website, detailing what they need to qualify for CRBA.

Timeline Summary:

K-1/K-2 NOA1 - POE: 9 February - 9 July 2010

Married: 17 July 2010

AOS mailed - Interview : 22 November 2010 - 10 March 2011

ROC mailed - approved: 14 February - 18 June 2013

Citizenship mailed - ceremony: 9 February - 7 June 2017

Ahh, spoke too soon, in this case father would have to been present in USA for more than 5 years before child's birth to get child citizenship after arriving in USA, and the option to get citizenship automatically based on naturalization requires both parents to be US citizens.

Looks like child and mother need to come to USA, and after 3+ years if and when mother becomes a US citizen at this point child can claim citizenship too.
