Can they ask for RFE at the 5th month ?????

So who can we talk to when we call USCIS to see if they have taken another look at our application? I hate not knowing anything at all for such a long period of time. We should be able to demand more information?!!

So who can we talk to when we call USCIS to see if they have taken another look at our application? I hate not knowing anything at all for such a long period of time. We should be able to demand more information?!!

No one. It is not a competitive business. Demand? Or what? You take your visa petition business elsewhere?

If someone moves it from one pile to another, it gets scanned and you get an update on your online system. Otherwise it is waiting safely in a pile somewhere. Check out the description of how petitions are handled in the pinned topic at the top of the K-1 forum. That's it. They arrive, they wait in a pile until they are picked up, opened, checked, approved or sent an RFE. Adjudicators (we are acquainted with a couple that work at VSC) process and approve (or send for RFE) 20-24 petitions per day, they work 10 hour days, 4 days per week. 2-3 per hour start to finish. There really is no update to give. They do not "take another look" at your file. They take ONE look at your file, approve it or not. If they DO take more than one look at it, it is not a good thing, it means they need someone else's opinion or a manual check of something (adjudicators do not do manual checks)if they cannnot approve it or RFE it from their cubicle using their computer, it gets sent to someone else and they go on to another file.

Consider what you have to send and what they have to check. How long do you think that takes? Birth certificate or passport, divorce certificate (maybe), letter of intent, proof of meeting. They go down the check list (they actually HAVE a checklist) It is there? Good. All that other stuff you sent? emails, phone logs, 200 photos? Ignored. Not necessary. It was put at the back of the file when your petition arrived and no one looks at it. Your petition looks like every otjer petition there. Whatever you did to organize it was undone and put in their own order. While they were checking their list they put your names in the background check, when they finish checking their list they look at the results of the background check. Passed? Good. Approved. Next.

It took me longer to write this post than they will spend on your petition IF everything is correct. That is not a guess. And what update would you be looking for?

There is only so much you can worry about. You only have to prove...

1. Petitioner is a US citizen (for K-1)

2. Both are free to marry

3. Both intend to marry

4. You have met in person within the last two years

Plus a filled out G-325a and a passport photo

That's it. If you provided adequate evidence of those things, you are good to go. That is all that is required for the petition and they will not ask you for something that isn't required.

I'm not sure who should you talk to if you want to know if they have look into your case, but they will just ask you if your case has been over 5 months otherwise, they will tell you to wait for 5 months mark and call them again. That happened to me when my fiance called them last week to check the status of our case.

Next week will be my 5 month mark, finally my fiance can call them again to check, hopefully no RFE for me. Good luck to us! :)

Good friend took 10 months. No RFEs. No issues, just took 10 months. Stop fretting over the 5 month mark. They will get to your documents when they do. There is NOTHING you can do about it, except move to another country. Nothing you can do but wait.

If your documents are all in order, then you WILL get the approval.

Now this doesn't mean the visa is automatically approved...Nope. That is soley up to the Embassy and up to a subjective decision by the CO at the Embassy. If anything, I'd worry about that step.

The agreed time is 5 months. Lucky for your "good" friend, he's got too much patience to wait for 10 mos. And you don't tell me to move to another country, i have a mind of my own and i'm not even asking for your suggestion in the first place and of course i know how the visa approval process is.

To everyone who got these dreaded RFE...at the almost 5 month mark, any of you mind sharing what the RFE's were for so the rest of us can sleep better at night? (or go into a panic if we have forgotten some of the same things! :blink: )

Ours was for my divorce papers which I stupidly forgot to include in the original package. A day after I sent it, I knew I would get an RFE for this. On the plus side, from the time I received the RFE in the mail until our NOA2 was less than 1 week. If you do get one, it's not necessarily a bad sign. It means someone is at least looking at your case then.

what is an "agreed time"? There is no compulsary time frame, there are guidelines...goals. That is all.

I see that you have the same NOA1 date as me. I agree with you; sure, the 5-month timeline is only a "goal," but most reasonable people understand that it doesn't seem very fair or consistent for some people to take only 3 months and others 8 months when neither had an RFE. I definitely understand your anxiety. You should join the July VSC (Vermont Service Center) forum (see link below); you'll find a lot of people who feel the same way as you on that forum.
