Trying to decide if this is the best for us

Hi everyone. A few weeks ago my fiancee and I started putting together a K-1 Fiance Visa, but due to some recent events, we believe that it'll be best for us to go ahead and get married while we're both together in the United States, since I'm only here till January 18th.

As of right now, we're hoping to get married as soon as possible and put together the IR-1 / CR-1 Visa request as soon as possible.

However, we have a few questions before we make any quick decisions. If all goes as planned, I'm hoping to take her back to the United Kingdom with me on January 18th, as February is an important month to us, seeing as its the month of our anniversary, my fiancee's birthday, and (of course) Valentine's Day.

This is where my questions begin, would it be wise for her to leave the US while we're waiting for approval of the visa?

Would she have trouble getting into the country if we're married?

She was denied entry before when we were just dating due to her lack of money compared to the length of time she wanted to stay. Customs thought she was going to try to stay in the country illegally (which was definitely not the case, at all).

If you could please, leave me any advice, we'd both be very appreciative.

You seem to be concerned about her entry to the UK. There's certainly no problem leaving the US as long as somebody can forward her mail. For issues about UK entry, you need a different forum. You might try in the Regional section.

You seem to be concerned about her entry to the UK. There's certainly no problem leaving the US as long as somebody can forward her mail. For issues about UK entry, you need a different forum. You might try in the Regional section.

Yes, we're both quite worried about her getting denied entry again. We just don't want to be apart for too long since the wait for the IR-1 / CR-1 is supposed to be about 8 months, I believe? We mostly just don't want her to be in the UK if she needs to be in the US though. If all she's going to need is for her mail to be forwarded, then that's not a problem at all. Thanks very much for your input and I'll check out the Regional section now. :)

8 months in the grand scheme isn't so great. I, personally and from what I know of the situation, would not marry in the US since fraud could be raised to slow the process. I would spend a great Christmas and new years and you can always go visit her in February. Wait out the time...it's part of the Journey. Be happy that the interview list isn't as long as some other countries.

Get married asap. As soon as you get the marriage certificate file the I-130. Approval takes quite a while so she should not be receiving anything of importance in the mail for quite a while. As for entry into the UK, if you have with you a copy of the I-130 and, if you have filed soon enough the receipt from USCIS, then you can show that as proof that she has no immigrant intent - because you are in fact going to be moving to the US. If you don't receive the receipt from USCIS before you fly then you could bring proof of postage, or something showing the cheque has been cashed if USCIS has cashed it but not sent anything to you yet.
