Can someone sponsor them selves to USA on a CR-1 ?

Hi,

I was wondering if someone could sponsor themselves to the USA on a CR-1 visa. I can not start work until frbruary so i can not sponsor my husband to get here. If he shows that he will have a job when he gets here that is about 125% poverty line guidelines, is he able to "co-sponsor" himself?

I might have a company or two willing to do so. But because it is a family visa the company can't bea co-sponsor it has to be an individual.

When he arrives in the U.S, if his income is coming from the same source as it was before he immigrated, then he can help meet the income requirements on the I-864 Affidavit of Support. If the income will not come from the same source, I think you will need to find someone else willing to be a co-sponsor

Have you worked previously and once you are working will you be above the sponsorship requirement?

A job he hasn't started yet won't carry any weight. Only if he had income that would continue from the same source, would his income be considered. Start by reading the excellent instructions that come with the I-864.

I am a Medical Assistant student and I finish in February. Meanwhile I am just working part imte a few hours a week at bath and body works. But i am having alot of trouble finding a co-sponsor. ALOT. Once i start working i will be making well over the poverty line. Unfortunetly, i do not have much more of an option. The only other person i have does not have previous tax years. BUT his company he works for might be able to give him a job and can show that he will ahve the job as soon as he enters the USA.

You need to meet the income requirement by the time your husband has his interview at the consulate. You might be able to get approved if you can demonstrate that you recently completed training for a new [better] job and have secured employment in the field of your recent training.

It will be many months until his interview so you have time to get the new job and show several months of income in your new line of work.

I don't think NVC or Consulate would agree to sponsor himself by showing his future job income after the immigration.

If he has a job currently in his country and this employer has U.S branch and willing to employ him in the U.S after his immigration, then he can declare his income as "intending immigrant's income in your I-864 with proper documentation. Still, you are the sponsor and in this case, there is only one I-864.

Another example of intending immigrant's income. If he has good rental income in his country, that will still continue to come even after his immigration. This can be shown.

Ya, I couldn't sponsor myself under the 'self guidelines' you propose..I can walk into a 60 grand a year job as soon as I get my GC..but they dont care..there are no GUARANTEES on "What If's" unfortunately. Had to get my mother in law to cosponsor.

as for Loto's point...consistent same source income that would work..passive investment, or if he own's some properties/assets that he can sell off..or cash on hand, where you combine assets to meet the minimum requirement.

Thank you.. I will try to do this and i hope it work.. I was told he will not be scheduled his interview until the co-sponsor paperwork is sent in. Is that true?

I didn't realize that your were already at the NVC stage.

Yeah, they won't send your package to the Embassy until they feel it's complete and the AOS is a major part of that.

Don't worry, you have 1 year to complete the NVC process so this will delay your case but not kill it.

Since your tax returns won't show enough income be sure to get an Employment Letter with your rate of pay and the fact that you're a full time employee from the place that hires you. It would probably be a good idea to wait until you've been on the job for 2 or 3 months so you have several pay stubs to submit and also can show that you're working out in the new field.
