Hi everyone,

Me and my HUsband have unfortunatley seperated. My question is, we will be married 2 years before anything is actually finalised divorce wise. does this count towards the 2 years conditions or does it have to be from the time you recieve your conditional green card? If its the latter, could you use the fact that we have been married for 2 years in argument to stay or would i def have to leave?

It wouldnt be so bad if i did have to leave, its just that i have a great job and friends here now so financially it wouldnt be wise to just up and leave.

The 2 years do not count if a divorce is filed. You will need to file a I-751 waiver once the divorce is finalized. The waiver is to remove conditions on your greencard since its a 2 year card. You wont have to leave if you are able to prove to immigration that the marriage was entered in good faith. If the waiver is approved, you will receive a 10 year greencard.
