cr1 after k1 sent back

simply our case ( k1 ) sent back for further review since 5 mounths now and every body here say to me it will not gonna work and you will not hear about it again for ever it will sit there to expire !!!!

so we decide to get married and cancel our k1 pettion , did you think it will be good for us did it it will us go throw the next time more eaiser at the interview ?

if we dont had our own home in the bencifrey country did it will hurt our case ?

i mean the fact you married is eaiser to get your visa , is more good than k1 pettion ?

did we need to register our marriage at the embassy before we file the before cr1 visa ?

also i had some more quiz help me in it plz ( just wanna to find out it will make our suitation more better ) :

1 ) my fiancee like to change her name after we married at the passport and every thing like social security number and every papers .

2 ) we need to make a shared bank account .

3 ) we need to put both of our names at the deed of the home .

4 ) the fact we file for the k1 before and its sent back did it will hurt us ?

5 ) did any body had his k1 sent back before and file for the cr1 and it work for him or it make it worst

any help will be apparcited

06-15-2008 : my fiancee first visit to me ( stayed 3 weeks ) .

06-23-2009 : my fiancee secound visit me in Egypt ( stayed 6 weeks ).

06-28-2009 : ENGAGED

10-29-2009 : I-129F Sent

01-27-2010 : my fiancee 3rd visit to Egypt ( stayed 6 weeks ) .

02-09-2010 : travel with my fiancee to turkey in a vacation (5 days)

05-25-2010 : my fiancee 4th visit to ( stayed 2 months ) .

06-03-2010 :Interview Date .

Interview Result : approved ( ya right ! )

07-01-2010 : we got a letter had my passport and over the visa stamp says ( canceled without prejudice )!!

06-29-2010 : case sent back to usa !!!

07-07-2010 : MARRIED

01-12-2011 : the letter state the k1 case is expired , and ther was no prob to file back for any kind of visa

04-25-2011 : my wife here now visiting me in egypt for 2 and half mounth yayyyyyyyyyyyy

05-18-2011 : travel with my wife to malaysia in a 1 week vaction

06-14-2011 : register our marraige papers in cairo

Hello! We are on the same boat! my original K-1 was denied visa because the consulate suspected we were already married! I tried to appeal and get my representatives involved to no avail. I went back home and married and got my marriage certificate. I came back and filed I-130 and submitted a copy of my marriage certificate with my application. You would need the marriage certificate in order to file for a CR1 to prove you are indeed married. Since the marriage is fresh I don't think you need to have a shared account yet, since you live in different countries.

I do not know if the process will be any faster this time but there should be less time spent on your background check since they've been through it before. Good luck

Why was your K-1 denied? If they suspected fraud then you will still need to overcome this. Make sure the two of you have spent time together and have plenty of proof that the relationship is genuine. Good luck.

Hello! We are on the same boat! my original K-1 was denied visa because the consulate suspected we were already married! I tried to appeal and get my representatives involved to no avail. I went back home and married and got my marriage certificate. I came back and filed I-130 and submitted a copy of my marriage certificate with my application. that was so stuibed of them to do you like this !!! so they need to tell you that you had more than enough to get your visa lol , but trust me if you use the sam evidance to get cr1 without front load your application it will not gonna work , hate that process

Why was your K-1 denied? If they suspected fraud then you will still need to overcome this. Make sure the two of you have spent time together and have plenty of proof that the relationship is genuine. Good luck.

we not denied yet our case sent back , but i belive its soft deny i guess , god only 1 know

what you mean by fruad , i dont think if we get married we will not cousider as a fruad nobody get married as fruad and if they think this they better think again , she visit me 4 times until now every time not less than 1 and half mounth and not more than 2 mounth

just need your help to explain what they can think its fruad ,

any help will appracitaed

No, that's certainly not the only thing they look at. Red flags are limited communication with each other, not knowing basic things that most couples know about one another (such as job, siblings, hobbies), and other such items. You don't have any worries.

You know right! I was surprised as they themselves admitted that they know we have a legit relationship but they think we were already married, so I should have filed for a spousal visa instead of a fiancée. These people don't need to sense any "fraud" to deny you. They deny people for ridiculous reasons such as what their "gut" tells them against what your evidence is. If I had filed for a spousal visa and provided thesame evidence, they would have found another reason to deny or simply say the evidence was not enough. We are all pretty much at their mercy, we have no choice but to dance to their tune.

I have seen cases with multiple visits and call logs that were still denied as not convincing enough. While there are other cases with just a couple of visits and a few call logs that got approved. As you can see, I gave them enough evidence on mine, which turned out to be "too much" and they thought we were beyond fiance and fiancee. If you go through different cases here on VJ and learn from other people's experiences, you should be well prepared. The main problem is the kind of CO that interviews the beneficiary. Some are just impossible while some are easy. Good luck as you gather yourself and try again.
