we got married year 2007 the first time we diddnt file visa petition after we find out that he was not divorced yet cause i know it gonna be useless cause it can rejected at the end....he got the divorce judgement last year october then we got married as soon as he got back here we filed our petiton may 2010 and got the NOA2 last month...I consult a family lawyer about this and he said im gonna be fine since i get married to the same person but my 1st marriage was null and void and i can't use the information on our first marriage anymore...He said on the interview i should tell the truth and present the divorce paper together with the CENMAR or the marriage index....I can't help to get worried still cause maybe the consul might think different...Im still planning to let my husband send me sworn statement affidavit on what the reason of getting married while his divorce is not done yet and i will get my CENMAR/marriage index aunthenticated by the DEPARTMENT OF FOREIGN AFFAIRS...

Well seeing you filed based on the second marriage I wouldn't worry about it. It shouldn't affect anything.
