hi everyone...I need your advice and opinion guys...we got our NOA2 last month and NVC is processing our case now...We got married twice...When we got married the 1st time he thought his divorced case was already finalized and judged already,all the paperworks was signed and got notarized already...his ex wife was the one that processing their divorce case before...he has the copy of the paperworks...until couple of months after we got married he found out that their divorce case wasnt file...what he did is refile the divorce case and finally got the decision last year since it took more than a year for the judgement of the divorce case because of some delays...we got married again a month after he got divorced....my question is will it affect my case since we got married twice...one of the requirements in the interview is the CEMAR/CENOMAR rite??if im gonna get CEMAR/CENOMAR it will shows there that we got married twice, the 1st one when he was still married and the latest one which is the valid one...when we got married the 1st time i know it was null and void since he was still married rite thats why we got it fixed and got married again...im so worried now!!!we have a son a 10 month old...his passport and CRBA was approved last month....Please give me an advice guys i know this situation is rare...im so confused!!! :( :( :(

I really dont understand why he didnt just carry the 1st divorce document from the Law Court to the Vital Statistics office of the state which he lives right know or where they got marry before.

I am divorced since January 2006 and i dont knew that in the Vital Statistics office from Puerto Rico havent the update of our relationship. I got marry with my actual husband in Turkey and when i returned back home i searched the mariage certificate and appear that I was still married with my 1st husband!!!

I just needed go home search that resolution from the Court Law in that day and I carried back to the Vital Statistics offices. They just made the change in the sistem and gave to me a marriage certificate with the update of that divorce.

But my actual husband and I dont need marry again... Unless your husband's ex-wife had annulled the divorce and the court sent him the notice.

About how can affect that in the interview... dont know, but if they dont ask u both about that point... dont talk about it!!!!!!!

Your first marriage is null and void. Your husband was not free to be married according to the family code of the Philippines. Now if it's on record I'm not sure? Your husband should have known if he was free this question is ask at the USEM for (legal capacity ) and divorce papers are required by the PI civil register.

Art. 11. Where a marriage license is required, each of the contracting parties shall file separately a sworn application for such license with the proper local civil registrar which shall specify the following:

(1) Full name of the contracting party;

(2) Place of birth;

(3) Age and date of birth;

(4) Civil status;

(5) If previously married, how, when and where the previous marriage was dissolved or annulled;

(6) Present residence and citizenship;

(7) Degree of relationship of the contracting parties;

(8) Full name, residence and citizenship of the father;

(9) Full name, residence and citizenship of the mother; and

(10) Full name, residence and citizenship of the guardian or person having charge, in case the contracting party has neither father nor mother and is under the age of twenty-one years.

thanks sjr09...what do you think do we have to do??cause for sure when i get the cenmar it will appear my 2 marriages date...i read in some forum other cr1,k3 and IR1 applicant get asked for CENMAR some diddnt...should i present the CENMAR together with the other requirements or just when they ask me to present one on the interview..should i ask for legal asisstance about our case......thank you guys for the replies...it really helps me a lot rite now

thanks for the reply..in the philippines we have to provide Marriage Index or CENMAR..its a paper that has list of all the previous and current marriage with dates,names of the groom and bride...im just worried maybe they will think different...some consul ask me why we just got married last year the fact that we know each other since 2005..theres a lot in my mind rite now...im blaming my husband for this im so really really worried...dont know if i have to get a legal asisstance for this.but i am married to the same man i dont know what the consequnces i have to face on our situation....i appreciated your reply so much..thanks again :(

I think if your NEW marriage is legit, backed-up with the proper documents you 'should" be fine

Get the certificate of no marriage record (CENOMAR) in your single and maiden name, if your ask for them at the time of your interview present them to the CO. Along with a copy of the divorce papers and an explanation in the form of a letter from your husband why he was unsuccessful, unable to be 'incapable' of doing it right the first time. I'm sure he was aware if he was or was not free in your first marriage, who say's I think I'm divorced, or my x-wife told me we are? (Water under the bridge now.) I think if your NEW marriage is legit, backed-up with the proper documents you 'should" be fine

If I were in your shoes I will consult a lawyer that specializes in family/marriage law for your own peace of mind. Or you can do what sjr09 advised you to do.

thank you for the advice lexlee08 rite now we cant afford a family /marriage lawyer which making me more upset...rite now our case is not done in NVC yet we still have time...might do what sjr09 adviced..salamat po again...:(

Yes Im the petitoner. 'No my wife was not ask for the cenomar at her interview, but some do get ask for the doc..

If the petition was filed AFTER the divorce was final and the second "marriage" took place you may well be OK but you'll definitely get some extra scrutiny at the interview.

When did you get married? We need dates. And when did you file your paperwork?

The first marriage wasn't real and you can prove that because of his divorce certificate dated AFTER your marriage but you will need to check Philippine requirements to see whether you need to file an annulment for the first one or something..

In terms of USCIS, if you filed your paperwork based on the first marriage then you will be denied because you weren't really married because he wasn't free to marry. If you filed based on the second marriage after his divorce was finalised from his ex-wife, then you will be fine.

we got married year 2007 the first time we diddnt file visa petition after we find out that he was not divorced yet cause i know it gonna be useless cause it can rejected at the end....he got the divorce judgement last year october then we got married as soon as he got back here we filed our petiton may 2010 and got the NOA2 last month...I consult a family lawyer about this and he said im gonna be fine since i get married to the same person but my 1st marriage was null and void and i can't use the information on our first marriage anymore...He said on the interview i should tell the truth and present the divorce paper together with the CENMAR or the marriage index....I can't help to get worried still cause maybe the consul might think different...Im still planning to let my husband send me sworn statement affidavit on what the reason of getting married while his divorce is not done yet and i will get my CENMAR/marriage index aunthenticated by the DEPARTMENT OF FOREIGN AFFAIRS...

Thank you guys for all the advice...It means a lot to me and i apreciated it very much...

im still new in this site and sorry for posting it twice..
