Please help...Case sent back to USCIS from state deparment for review????

Hi, I filed my case I 130 for my husband on August 06, 2010. I am a US citizen.

Received a notice in beginning of November that the case was being transfered from California Service Center to Texas Service center in order to speed up processing. Today, nov 24 I received another notice stating...

Your Case Status: Post Decision Activity

On November 24, 2010, a USCIS office received this case from the State Department with a request that we review it. We will notify you when we complete our review, or if we need something from you. If you move while this case is pending, please use our Change of Address online tool to update your case with your new address or call our customer service center at 1-800-375-5283.

I called up USCIS, and the person I talked to told me that I need to wait 120 days for the review, and then call again.

He also told me that my case has been approved and that it was sent to NVC but they sent it back for further review. We've been married for 3 years, and it's going to be 9 months in December since we've been apart.

Has this happened to anyone else? If so , how long did you wait for the review? And what was the outcome ?

Usually if its approved but sent back something is wrong. They need to look at it and re-evaluate the aproval. The USC might have an interview or they might deny it or they might approve it again and send it back to NVC.

we don't know what does it means? only thing in my mother-in-law case is that she visited US many years ago and we mention it in here I-130 application. we think that USCIS may want to check her old visa. what else??

I'm not sure either, I don't know what the reason could be, I'm hoping it's because the USCIS messed up something and NVC is returning the case in order for them to fix it. IDK ...but I really hope someone could tell me if they had a review like this, and how long did it take?..

Newbie: I have exactly the same dates as you for my I-130 (August 6, 2010 - receipt date) and November 24, 2010 "USCIS received this case from the State Department". However, it didn't say whether it had been approved or denied but with the information that you got on your case, I would assume that my petition was approved, sent to the NVC, and then sent back to USCIS.

I want to keep in touch with you to see how long this takes. My wife is Lanny in Jakarta, Indonesia.

I am also filing for my husband who is also in Bosnia. I recieved the same notice. I tried calling USCIS and they told me the same thing. I don't see any reason why it would get returned and noone can give me an answer either. So I guess we are in the same situation. I filed August 18 2010.

Oh that's great, are you from Bosnia?..Yea I don't see any reason why they would send mine back either, we've been married 3 years now and I've lived with him in Bosnia for a year. I don't think that they can suspect fraud, cause it's definitely not, it probably has something to do with the paperwork and with USCIS. I'll def post back when and if I receive anything, and I have a strange feeling that we might all get a notice by end of December. Cross our fingers !!! :)

I really hope so, Yeah im also from Bosnia, we got married in July but have been together for 4 years. I don't see any reason why they would suspect it as fraud either. When I look at other people who have recieved this notice earlier this year it seems as if they have waited over 5 months so far and still no response. I heard when gets transferred back from the State department, that we are all the way down on the priority list. SO Im freaking out not knowing whats going on. Im really hoping we get a response soon. But its strange a lot of people in August who have filed have recieved this notice. Lets hope for the best. If I find out anything ill be sure to post it here so we can keep each other updated its hard to find people from Bosnia who are also filing for i 130 in the same timeframe.

I honestly feel that this is some type of error on there part because when I search online a lot of people who have filed in August are recieving the same message. This doesn't make any sense and noone can give an answer as to what office my case is in. All the information I have is that it will take a minimum of 120 days to get a response.
