Please help on the 864

I'm new. My husband, USC and me, Canadian citizen. We filed the I-130. I need help. My husband is employed in the US, makes 44k annually. We do not have kids yet. He does have an apartment, he does not own a home. Will we need a joint sponsor for the 864? He has not filed US taxes for 3 years cause he was living in Canada with me. This is his first year in the US since 2007. The poverty guidleines are confusing me. He has 3k in savings and my RSVP is at 10k, Canadian. Please help. I am overwhelmed. I filed DCF. Trisha

He is making 44 k which is very good

Assuming the 44k annual salary is the current, you shouldn't need a co-sponsor. He will need a letter from employer stating his income and pay stubs. He might have to do taxes though for the previous years IF he received American income to satisfy those 3 years of records even if his income was lower than needed to report taxes.

Poverty Guidelines are confusing :wacko:for 2 people it is 125% of $18210 which I round off to be $23000/year if you are over that even by a little you do not need a co-sponsor.

I don't know anything about DCF sorry :star:

If he makes 44k as of this year with the current US company then yes you guys are good to go(no co-sponsor needed). I am sure there is a dcf forum, you could also message Birdnerd, she has gone through this recently and she may be able to help you with your questions.

Unless your husband did not work while living in Canada then he definitely is required to file U.S. Income Tax returns. U. S. citizens are taxed on their worldwide income. If he worked while in Canada he might not owe any tax on his U.S. tax return but he still has to file to claim the foreign income exclusion. I recommend you and your husband read IRS Publication 54, Tax Guide for U.S. Citizens and Resident Aliens Abroad. Here is a link to the publication:

Unless your husband did not work while living in Canada then he definitely is required to file U.S. Income Tax returns. U. S. citizens are taxed on their worldwide income. If he worked while in Canada he might not owe any tax on his U.S. tax return but he still has to file to claim the foreign income exclusion. I recommend you and your husband read IRS Publication 54, Tax Guide for U.S. Citizens and Resident Aliens Abroad. Here is a link to the publication:

OP, your sponsor is good to sponsor the beneficiary alone, without the co-sponsor. But make sure the written explanation why he didn't file the taxes or start arranging to file the prior year taxes after consulting a CPA.
