On February 3, 2011, we mailed you a notice that we have approved this I130 IMMIGRANT PETITION FOR RELATIVE, FIANCE(E), OR ORPHAN. Please follow any instructions on the notice. If you move before you receive the notice, call customer service at 1-800-375-5283.

For approved applications/petitions, post-decision activity may include USCIS sending notification of the approved application/petition to the National Visa Center or the Department of State. For denied applications/petitions, post-decision activity may include the processing of an appeal and/or motions to reopen or reconsider and revocations.

I hope this is approval. I had already called my wife that our case has been approved. Plz god, make it approval. I have no courage to tell her we are not. She was so emotional, and I know she was crying.

Just realized TSC is near Dallas.. oh yeah.. unless people are working from home they might be getting some work in but nothing is being done at TSC.

They got a lot of snow considering it is Dallas.

Have you guys send an email to "scopsscata@dhs.gov" ? I hope this might help. Just write an email explaining what you are going through mentally and your petition is way over the procesing time. Be emotional in the email. That might help getting your case approved.

I think today, I will be speaking with a immigration lawyer today, and discussing the violations of the US Code that have been committed by the USCIS. I will also mention the CFR's that Fermat was so nice to post up. I will be submitting a FOIA to the USCIS in regards to this case, to find out exactly what the hold up is on there end. But at the same time, I will be engaging a lawyer to assess what recourse we have by filing in Federal Court against the USCIS for the violations of the US Code. If anyone else is speaking to an attorney about possibly using the Federal Courts and bringing suit against USCIS, lemme know. If there is a valid basis for the case to go forward, I'm sure that it will be a class action lawsuit.

I'm tired of not having my wife with me, and soon to be child. So no more, I'm done with writing, I'm done with calling, I'm done with begging my reps in Washington.. it's time to take the only recourse left, and that is to file against the USCIS for violations of the USC and CFR's and them not doing anything to correct the situation.

§ 1571. Purposes

(a) Purposes The purposes of this subchapter are to

(1) provide the Immigration and Naturalization Service with the mechanisms it needs to eliminate the current backlog in the processing of immigration benefit applications within 1 year after October 17, 2000, and to maintain the elimination of the backlog in future years; and

(2) provide for regular congressional oversight of the performance of the Immigration and Naturalization Service in eliminating the backlog and processing delays in immigration benefits adjudications.

(b) Policy

It is the sense of Congress that the processing of an immigration benefit application should be completed not later than 180 days after the initial filing of the application, except that a petition for a nonimmigrant visa under section 1184 © of this title should be processed not later than 30 days after the filing of the petition.

Bills?? Proves of wedding?? The certificate is not enough?!! It proves the fact that your wedding actually took place. What bills have to do with this fact? What if there are no bills? What is the wedding was very informal (my case)?? What's the connection here? I can't believe that, that's too much. The marriage certificate needs some supporting evidence in the form of bills... wow... speechless...

I guess they are testing us. They wait 6 months to tell us they don't agree with our wedding, like if we had to have their approval to get married. Last year they approved a fiancé visa, today they don't approve a spouse visa, :bonk:

But, well we've got to provide them with documents they already have. The bad thing is that my hubby is so furious that he doesn't want to send anything and here I am praying for him to put his mind in its place and fedex the docs asap.
