I-134 and a co-sponsor

Hello everyone. I am completely stressed at the moment and would appreciate any advice that anyone can give. Here is my situation.

I was working in Los Angeles for the past few years as an Accountant wit one company and doing side gigs as an actress/voiceover talent. I received income from many different entertainment companies along with my base salary from my accounting job. All in all, my income tax return from last year shows about $68,000. I left Los Angeles and my job in January, moved to Brasil, fell in love. I teach English part time here in Brazil on a contract basis but its not very much money at all. I applied for the K-1 Visa for my fiance in August and expect to get my NOA 2 next month. I am now 3 months pregnant....and need to get back to the US as soon as possible, but I want to be here to attend the interview with my fiance. So I will wait until after his interview to return...hopefully with him by my side. Here is my dilema: When I fill out the I-134, I will not have proof of income as I am virtually unemployed by US standards.

1. Can I apply as being self-employed and hope that my income tax statement from last year will be sufficient?

2. My mother is willing to co-sponsor my fiance. She has sufficient income for a household of 3, and she owns her own home. Can I use her as a co-sponsor?

3. If I can use my mother as a co-sponsor, do I still need to fill out the I-134 for myself? And if so, is it ok to flat out say that I am unemployed?

4. The bank letter that they are asking for will be a bit difficult for me to get an original signed copy being that I am in Brazil. Can I just use copies of my bank statements for the past year?

5. Do I need original copies of my tax return or will a photo copy be sufficient?

You're living in Brazil. Did you plan on lying about that? Your income tax statement alone probably won't be enough since you're obviously no longer working at the same jobs.

Yes, probably. Some consulates are known not to accept co-sponsors for K visas, but I haven't heard this about the consulate in Brazil.

Yes. You are the primary sponsor. You will have to submit an affidavit of support. You can say you're unemployed, since the approval will be based on your co-sponsor's income.

They ask for bank statements as proof of current revenues. Bank statements from last year wouldn't tell them as much your tax return from last year would, so they would be practically useless.

5. Do I need original copies of my tax return or will a photo copy be sufficient?

You don't have to print up new copies of your tax return. Photocopies are fine. You also have to include copies of W2's, 1099's, whatever else would have been filed with the IRS. It's easier to just get a transcript of the return from the IRS. It's free, and it only takes a couple of weeks.

hello to answer ur question i have a friend thats married to a filipina and he used his mom as a co sponsor and got approved and his mother wasnt even working she drawed retirement social security... so what i would do is

do 2 I-134 forms 1 on you and another with ur mom list any assets u may have then on the form of ur mother list the home ur mom owns and what its worth using ur mom as a co sponsor is ok the reason u hear of some co sponsor getting denied is cause the co sponsor they ised was not a immediate famo;y member u should be ok i myself just sent in a petition and i draw SSI i listed on my G325a disabled from birth and come interview time ill send in 2 I-134 forms one on me and one my mother to the 2nd part of ur question the co sponsor is the one that has to meet the income requirements so it shouldnt matter that ur unemployed the sponser is the one who is responsible for ur girl and to the last part to be on the safe side id send a original of ur tax return not always but some CO will ask 4 originals so have it handy incase

I am currently unemployed as I'm a full time student right now. My mother was the co-sponsor for my husband and we had no problems. I submitted both I-134 (one for myself and one for my mother). On mine I put that I was a full time student and attached a not explaining why I had no tax returns to submit or income to show of. For my mother I submitted print outs of her tax returns (she filed all online so I just printed what she had), a letter from her employer showing how long she has worked there, her job, salary, etc., and her birth certificate. I did not include any bank information since my mother's income was above the income required. My husband submitted all that information at his interview in Rio and had absolutely no problems at all. Not to say that they might want something more, but for us what I sent was fine.

As per a conversation with an interviewer at the Rio Embassy "Yes, we (Rio) accept co-sponsors". So if your co-sponsor has sufficient income above poverty than you are good. Just need the documentation for it all etc.
