I have a returned petition back to uscis from the u s consulate lagos nigeria, i would appreciate your advice on this one.

I have been knowing my husband since 2001, then we just used to talk to one another on the phone, but i never knew the relationship will end up into marriage, we were just friends, i knew my husband through my senior sister who is a u s citizen, but my husband is not a nigeria,he is a born citizen of the united states he is a black american. So as time went on he became fond of me, and later the relationship became stronger, then in 2004 my husband then file a k 1 visa for me to join him in the u s, but before then he had already proposed to me and ask me to marry him that he did on the phone, but all these while my husband and i had never met in person but we are truly now in love, but when he filed in the k 1 with the uscis in 2004, the petition was denied by the uscis, the reason was that we had never met in person and that my husband have to come down to nigeria and meet with me in person. So my husband started to make the arrangement and then in the year 2007, my husband visited me in nigeria and we had the introduction and he then formally proposed to me in front of my whole family and put the ring in my fingers. When he returned back he filed in a k 1 visa and it was approved and i was granted an interview with the u s consulate lagos in april 2008, i was denied the visa at the u s consulate lagos the reason was that it was not a bonafide relationship but only for immigration purposes and it was sent tio the uscis, then in july of 2009, i had my traditional marriage in the U S, the reason was that my parents live in the U S, my parents have an immigrant residence and my husband's people are there too and it has be agreed by both parents that is will be held there, then in august of 2009, my husband and my parents came to nigeria i had the court and the church wedding in august 2009, then when my husband returned back to the u s to file, after some weeks he received a letter from the uscis that our k 1 has expired, then my husband filed in the I130 petition. The I130 petition was approved and sent to the u s consulate in lagos in april 2010 and i got an interview date for 29th of june 2010. I went for the interview, and they gave me another letter that my marriage is not a bonafide marriage its just for immigration purposes exactly what they did to me in 2008. I got home and spoke with my husband and he wrote the u s consulate was told that the case has been closed in lagos and we should deal with the uscis. My husband got in touch with the congressman and the congressman had to find out what happened and the reason was that, why i was denied was that i said i met my husband in 2004, and in 2010 i said i met him in 2001, but you see the visa officer misunderstood what i told her, she quoted me wrong,and she said i do not know anything about my husband which she was wrong either.

These are the question she asked me.

1 who filed in your petition, i told her my husband

2 how do you know your husband, i told her through my senior sister

3 What are the relationship between your husband and your sister, i told her they were collegues they used to work in the same office and they were fond of each other. There she refused to believe and told me what has collegues got to do with family and she concluded that i was telling her a lie, but i said to her that i wasn't lieing and that was the truth but she refused.

Then she asked me other personal question which i answered her correctly.

She asked me when i have be knowing my husband, i told her 2001, but we were just friends then but the relationship got serious in 2004, and she asked when did you first meet your husband in person, i told her in may 2007, She then said how come in 2008 i said i met my husband in 2004, but you see i told her that i have been knowing my husband in since 2001, she mixed up the whole thing and then said i am a fraud.

Now the documents are presently with the uscis, the uscis received it and sent my husband a letter that they will get back to us after it has been reviewed. They received it on the 17th of september 2010.

Please what should i do now while i am waiting for the uscis.

I would appreciate your opinion.

You have a bad history of denials. The first one was because you didn't understand the rules for a K1. The others are building up against you. We were denied for a truely bogus excuse also. You should contact a good lawyer for advise at this point because you are probably close to causing irrepairable damage to your case. I used Marc Ellis who specialized in denails. He is a member here ( ellisisland ) there is also a site immigrate2us.net

This will not be over quickly. You will not enjoy this.

Well, what you said with your mouth is not enough evidence to deny you an immigrant visa, A visa applicant can make mistake and correct it immediately, the most important thing there is the evidence that was before the interviewing Officer ,On what you said you have a great preponderance of evidence to prove that your marriage is bonafide not fraud since you have known your Husband since 2001 and both of you have been communicating until your marriage in 2008 as you said. You have a great chance of getting your Visa from the Consulate if you have a good Immigration Attorney that can give the US Consulate a big fight, Ask your Husband to contact a good immigration Attorney within her juridiction of residence in the US to get your case re-affirmed. Your Husband has the legal right to proof that your relationship and marriage is bonafide by the documentary evidence not by what you said in your mouth.

The US Immigration law states that the petitioner is required to show bonafide relationship with the beneficiary,based on this, the burden proof to establish a good bonafide marriage lies on the Petitioner which your Husband, Your Husband has to give them a fight through a good Immigration Attorney in the US who knows about returned immigration cases for revocation by the US Consulate.

Again, I guessed, the reason for the US Consulate denying the Visa is because your records prove that you been denied on K1 and your Husband did nothing to get the case re-approved when it was returned back at the first time. US Consulate Like to re assured them again that your case is bonafide when it is being returned back to the USCIS for Revocation than allowing the case to expire. Even if the USCIS tells you that your case is expired , a good immigration officer will ask for the reason why the case was allowed to expired without prejudice. An Immigration Attorney will request for re-opening of the case by filing form 1-290 for the expired K1 Visa.

I am advicing you to tell your Husband to contact a good Immigration Attorney to avoid the case been finally revoked by the USCIS on time. He doesnt need to re-apply a new one without knowing the reason why your K3 Was denied, otherwise if he does, he lose a lot of money , time waste. He has wait to receive a response from USCIS regarding the returned petition and tell him to hire a good Immigration Attorney while you wait. Believe it, your case will be revive again and get re-affirmed with a recommendation for a Visa than doing it yourself.

Just get relax, countine talking with your Husband, Do not allow that to disturb you at all. It must be revived, How you met did not matter and how you came to know your Husband did not matter, What matters that you have followed the Law and the evidences before the USCIS counts than what you said with your mouth when it is being properly evaluated.

Relax and make sure that you eat well. I am in the US ,I am married too here in the US, We will be expecting you to join just soon.

miil i will strongly advice you to send a personal email to nigeriaorburst for further information on getting the lawyer because your case is too complex to be solved here on vj except an intervention.

Thank you all for your responses, i do appreciate it, actually my husband and i had all the evidences since 2004, i provided the consular officer with all the evidence she asked me in 2008 and 2010,i had photographs of my husband and i, photographs and videos of our introduction, traditional marriage, court marriage and church marriage, phone details, e-mails/im chat, my husbands taxes, marriage certiicates.

Mr Ellis has taken several cases from Nigeria and I think they were successful. He is one of the immigration attournys that other ones study to learn the ropes. His speciality is denials and because he is so good he chooses what cases he takes and refers others to people he knows. He also charges fees depending on the amount of work he expects to have to do and he is the only one that can tell that. However in my opinion he is reasonable. If your petition expired was it a K3 and not a CR1/IR1 ??

This will not be over quickly. You will not enjoy this.

My petition that was expired was the k 1 which was the first petition i filed before we decided to get married, the petition which is on review with the uscis is the I130 which my husband filed last year 2009 and which i was called for interview in june of 2010.

afer reading through Mill's experience at the embassy, i am scared because my case is similar. I was denied a K1 in Feb. 2010. Reason: evidence submitted shows that by nigerian laws, i am already married to my husband and so not eligible for a K1 visa. Prior to filing of the K1 in 2009, my husband and I already had our traditional wedding in Nigeria

My husband came to nigeria after this denial and we had our court wedding and even got a CRBA and US passport for our daughter(who was born Dec 25,2009), after which he went back and filed the CR-1 for me in april 2010.

USCIS has written my husband a couple of months ago that they have received the K1 petition back from the Consulate and are reviewing the case. My husband simply ignored because we are already processing the CR-1 visa.

Should i be concerned? what do we do pro-actively to ensure i am not denied a 2nd time. Please help. The Lagos consulate is like facing the Devil's advocate.

My husband visits like once in a year. He has not added me to any insurance. I remember he tried opening a joint account for us and the bank said i did not have a social security number. I guess the same limitation applies to the insurance. Yes, we do keep track of e-mails and phone records + money transfers + DHL slips of all items sent to me and the baby...what more will i need?
