God bless everyone who helped me in my plight here. I feel like a total moron. So I don't request a waiver, just simply submit my evidences, correct? If the officers deem it nesessary, they will send me a waiver, right?

Jabree, I am not aware of an actual waiver form in regard to this meeting requirement (although it certainly may exist). Everything I see on the I-129F form about waivers are in regard to those seeking a waiver of the filing limitations imposed by IMBRA - the meeting requirement is not part of the IMBRA law.

On the original I-129F instructions it explains that you may file the I-129F petition if you

1) Are a USC

2) You and your fiance intend to marry within 90 days of your fiance's entry into the US and are both fre to marry

3) Have met in person within 2 years of filing the petition unless It is established that the requirement to personally meet your fiancé(e) would result in extreme hardship to you

Question #18 specifically asks if you have seen/met your fiance in the two years prior to filing the petition and says:

Describe the circumstances under which you met. If you have not personally met each other, explain how the relationship was established. Explain also in detail any reasons you may have for requesting that the requirement that you and your fiancé(e) must have met should not apply to you.

My assumption is that you did not provide enough explanation for this question and now you have received an RFE to explain further. Therefore, you need to provide enough information on your RFE response for USCIS to agree that you are eligible for an exemption to this requirement. I would do some research first on this -- it seems that they require a particular type of proof of how your meeting would result in extreme hardship to you. If you can prove that, beyond a doubt, you should be fine. Not sure if that's possible.

so i am ASSuming i send in just the evidences first? I can do that Monday mourning ( morning ). I have been ready for these tards...i had to occupy myself somehow during this gargantuan wait.

Curious--if you've been ready for them and you knew you were going to do this, why didn't you just send in your I-129f with your evidence and the request to waive the 'in person' requirement?

Like Boiler, I've seen several attempts at this, but never heard of one succeeding, even when someone was medically contraindicated for flying.

the reason being was I did send in something at the time i filed, but apparently i did not know then what I know now, thanks in part to VJ. The evidence I initially sent in was weak. during the waiting process, I reserched the heck out of this and now I am prepared to proceed with what i deem as a strong case.

I realize that it is a roll of the dice, but miracles do happen, and I am a firm believer. It will be in God's hands.

I want to personally thank every one of you who responded to my post. Kathryn41, a special thank you, I already wrote the letter you suggested.

Sorry that I could not offer any advice. With that said, If you have a strong case against the RFE requirements, then you will be ok.

Once they have the RFE back, you will be approved. Plan for success and think positively!!!!
