l-134 or l-864 how do I know which one I need of the k-1. Im confussed as to which one I need. (why are there two?) I have actually already filled out a l-864 and a l-864a for our co-sponsor just waiting to send to him for his interview. But I guess I have spent to much time reading and now I am not sure which one I need... I am hoping and praying for a fast approval and dont want to hold up the process any on my side of things...I want to have all of it ready to sen as soon as I get the NOA2. Thank you in advance for the advice and I am sure this is a stupid question please for give my ignorance :)

July 24,2010- Nigel proposed!!

September 1, 2010- posted the k-1 (lewisville address)

September 3, 2010 - forwarded to dallas

September 6, 2010- recieved in dallas

September 7, 2010 - forwarded to vermont service center

September 8, 2010- offical date of NOA1

September 9, 2010- text and email alerts 2:30 a.m.!!! but worth being woke up to

September 10, 2010 check cashed

October 3, 2010- joined VJ going bonkers waiting....

March 4, 2011 NOA2 after a long 177 days waiting ( no text email or onliine update.. still says in review)

March 10, 2011 NVC received and issued LND#

March 12, 2011 NOA2 hard copy received

March 17, 2011 we are at London.. packet 3 sent out

March 18, 2011 packet 3 sent back to London

March 22,2011 MRV-paid

April 1, 2011 Medical

April 15, 2011 Interview- Approved! orignal interview date May 13 requested to move forward received less than a days notice.

Fiance ones are the I-134 and you give him that and package 2 forms which is on the London embassy website you can download there. Fiance is this one, you need to send him your financial stuff with that so he can show the London folks at the interview.

4/25/2011 - NVC sent via DHL to consulate

5/2/2011 - Packet mailed

7/25/2011 - Visa approved

I864/864A is what you'll need. You should wait.....its not required now.

I-134 for K-1. When you eventually get to AOS you need the I-864. And for someone to use the I-864A to help you meet the requirements they need to be a household member. They would fill out a separate I-864 as a co sponsor who does not live with you, just FYI.

That's what I understood, too. One should get famiiar with both forms as the I864 had a lot more information.

Isn't it too early to complete these forms? Shouldn't it be for the interview or just before? I've sponsored 14 family members five years ago and I remembered sending them as they were getting ready for their interviews.

thank you for the link I think we understand it better now..... I am parnoid that I am going to provide the wrong information at his interview which would slow things down :( thank you all again!!

The I-134 is not a legally binding affidavit, it is used for non-immigrant visa's. Up until you marry (and subsequently file for Adjustment of status) the non-USC fiance will hold a non-immigrant visa. This allows them to get into the US before having a legal relationship with the USC fiance. The I-134 will need to be filled out by a qualified sponsor (the USC if he/she doesn't earn enough $ then also a co-sponsor) This form will need to be notarized. This does not get sent with the I-129F application. This is only submitted to the Embassy during the interview. Each Embassy will have information on this and will send it to you soon after your approved I-129F is forwarded to them.

The I-864 is a legally binding contract that the sponsor will be financially responsible for the immigrant in the event the immigrant attempts to benefit from certain federal aid programs. This form is filed at the Adjusment of Status part of the journey (after the Non-USC has travelled to the States and you two get married). I believe the new forms do not need to be notarized (check this) as they are already legally binding.
