Timeline

Hi Guys,

I'm planning to marry my finace in China this coming November. Shortly after, I plan to apply CR1 for her. I am aware of the long wait (I think 8 months-10 months?) that it takes before the CR1 is processed.

Here's the problem we're faced with. She plans to attend law school 9/2011 here in the states. Since the processing time for CR1 is so unpredictable (not to mention possible RFEs and stuff during the process), we're not sure if she can get her permanent residence before her school starts. Is it possible for her to apply for the standard student F-1 visa while the CR1 is processing? We're worried that she cannot attend law school because she's ineligible for a F-1 while the CR1 is pending.

Then why don't she apply F1 before marriage? It will be difficult to get F1 during CR1 pending.

Ok, other option is file CR1 and the wait is 6 (best case) to 10 (worst case) months. Getting F1 would be difficult once CR1 is in process, but you may try.

The reason why she can't apply for F1 before our planned marriage is that F1 visas are only given about 3 months prior to the semester starting. So the earliest she can qualify is June.

Thanks for your quick replies LotOfPatience. 10 months worst case scenario is not too bad, though she would not be in time for her law school starting date. I'm hoping for 8 months or less.

Ok, good luck! In order to avoid RFE, carefully fill the forms, show as much evidence as possible for the bona fide marriage and do more research before sending anything to the govt. agencies.
