Soo I'm the Petitioner in the U.S and my hubby is the benificary in Canada. When he was young he did 3 stupid things in 1998 when he was 19yrs old. I've been getting really worried and nervous now because of what I'm ready about other peoples stuff on this site and about what they say about getting arrested and so on. SO we went to get the police certificate and it came back clear which is awesome. But I asked him again what about the stuff you did when you were younger how come they don't show up, so while I'm still visiting here we decided to go back to the police station to see if we can get some sort of paper showing resolution that the cases were dropped for the interview stage ( in case they ask for court records and so on) The officer came with a printout and told us he can't give us the copy because its for police records only but wrote down the dates and offenses, they are :

1998-03-26 Theft under 5000 ( he was in the airport and found a purse left on a luggage cart and took it, then the police found him outside afterwards and he got arrested went to court but the case was dropped because they said he didn't take the purse of anyone he found it) they also gave him

1998-03-26 Possesion of property obtained by crime ....for that purse senario.

1998-07-03 Possesion of a controlled substance ( cop found him and his friends smoking pot, took it and gave them a talking too then let them go , the case was dropped)

1998-07-24 Fail to comply with appearnce notice ( he was scared to show up for that pot thing, and he ended up going at a later date and they gave him a conditional be good for a yr and they dropped the case ....

SSOOOOO thats the ####### we have been thinking about and we are really scared now....1998 was a bad yr for him and he learned alot. Ever since the last condtional be good for a yr he has been good till the age of 31 now. I am hoping that counts for someting and everything will be okay. I am trying to keep in mind every case is different and being positive about it, but it's hard. I just keep thinking it has to mean something that he was 19 yrs old when it all happened and now he is 31 yrs old and has had no trouble since then. We are answering yes to the question about have you ever been arrested charged or convicted because yes it is true at some point in his life he was. The cop at the station said his police check came back clear because all his cases got dropped and after 7yrs or i think he said 5 everything dropped gets cleared...but the immigration goverment may be able to see the stuff. Thats why we deicided to go to court today to get court records showing everything has been dropped, we are tyring to think ahead for the interview to have court records available...he had to fill out 4 papers for each incident and the lady said it would take 12 weeks for the records to come. We are just not sure how to get the police records, the officer said he wouldn't give it =/

For the medical he will have to answer yes to taking and using pot. Even if it was only once they ask, have you ever in your life time taken or used any drug substances.

But even Bill Clinton said he smoked pot....BUT did not inhale, and HE became president, so it sounds like a forgiveable offense.

I am giving the OP a heads up about the medical and having to disclose information at the medical about drug use.

Yeah, my husabnd wants to be honest and truthful about everything, he is a honest man. He says the immigration people just want to catch you lying, they want to probe into everything in your background and catch you lying, they just want to see if you tell them the truth and are honest.

So what happens after you answer yes to the medical, they jot it down and it's a flag for automatic denial =(

The DR I had said if my answer was yes he would " have to make some calls " Iv never done any drugs tho so I never got to find out what calls or what would of happend. I think if its once its not as bad as a chronic user. Hes right they pretty much want to catch you in a slip up.. Best to stay honest tho and I dont think 1 time use is grounds for denial.

Edit - specially when you say the case was dropped about the possession charge. He might get asked about that at the interview in which case he would get the chance to explain it/ show the stuff from the cop saying the record is clean etc.

This freaking sucks, I think it's stupid that some people get denied because they smoke some pot years and years ago. Like what about them mainting a job and being law abiding citizens since those years. And I've also been reading online that if they do hair tests, marijuna stays in your hair follicules for years and years. And I don't know what kind of medical exam Toronto does.

In regards to the pot, I recall reading a story about a beneficiary in the Dom. Rep. who was asked if he had used drugs in the last 6 months. He truthfully answered yes...and was denied, and told he would be eligible to re-apply in 3 years. I wish I could direct you to specifics or the place where I read this, but I can't remember where it is. However, if that's the case, then maybe there is hope (if your husband hasn't used drugs in the last 6 months)! And even if he had, it seems like he wouldn't be ineligible forever.

Minted - that's 2 different questions. Like Inky said, there is a difference between doing it in the last 6 months and doing it 10+ years ago.

He needs to say yes to that question if asked 'ever'(because lying about it is exponentially worse). But obvioulsy can say no if asked in the last 6 months

Yeah he's like a little truth bubble lol lying with this stuff is a big no-no.

This just sucks, it's so upsetting when you see illegal people in California and you think my husbund and I are going through this whole situation and then theres some illegal immigrants here.......and you know whats worse they act like they should be able to stay in Cali.

You won't get denied for smoking pot. They are not going to check your hair follicles! In many states, marijuana is legal for medical use. This site breeds paranoia... I know it's a really scary process, but the medical doctor is not going to be unreasonable or play god with you. He/she is there to make sure that you pose no threat to the population. You can't try to game the system, just be honest, and it's not so bad or unreasonable as some people on this site think.

While the end result may not be a denial the filer may indeed have issues if they do admit to previous drug use as the link I posted illustrates. Granted in the OP's case the use was years ago, so while I agree that it should not cause any problems I don't think it's wise to tell the OP it definitely won't be a problem.

Yeah OBX....that link you gave me , her story was crazy. But i kind of think they are looking at a 17 yr old and think she is more likely to smoke again because she is young and undecided in life. Versus a 31 yr old who is a law abiding citizen. I'll hope for the best.
