i and my fiancee decided not to go on k1 visa but rather shift to k3 or cr1. WE PLAN TO GET MARRY HERE IN THE PHILIPPINES THIS COMING MARCH 2011. THIS IS ALSO OUR FIRST MEETING. THOUGH WE HAVE SUFFICIENT EVIDENCES TO PROVE OUR BONIFIDE RELATIONSHIP ONLINE. WOULD THAT BE A PROBLEM THAT WE GET MARRIED ON THE FIRST MEETING? IT WOULD BE VERY EXPENSIVE FOR THE BOTH OF US TO WE MARRY ON OUR SECOND MEETING, TAKING INTO CONSIDERATION THE FINANCES WE HAVE. AND I ALSO WOULD WANT MY PARENTS TO BE THERE TO WITNESS OUR UNION THATS WHY I CHOSE TO GET MARRY HERE IN PHILIPPINES. AND ANOTHER THING, WHICH IS FASTER, K3 OR CR1? I HAVE READ LOTS OF CONFUSING STATEMENTS ABOUT THE TWO.. AND RIGHT NOW, IM CONFUSED. ...

PLEASE HELP ME. THANKS..

cr-1

K3 is more expencive in the long run and takes longer. You have to apply to adjust status and cant work when you get to the USA.

CR-1 you would be able to work right away when you got to the USA.

THANKS FOR YOUR REPLY..

IF WE GO WITH YOUR ADVICE, DO WE STILL NEED TO PROVIDE EVIDENCES THAT WE HAVE AN ONGOING RELATIONSHIP EVEN IF WE HAVE OUR MARRIAGE LICENSE, WEDDING PHOTOGRAPGS, AND PICTURES TOGETHER? DO WE STILL HAVE TO PROVIDE CHATLOGS, EMAILS, PHONE CALLS,PRIOR TO OUR WEDDING TO THE EMBASSY? JUST LIKE ON K1 VISA?

The K-1 is normally much faster than the k-3. SAVE everything you do, chat logs, emails, all phone records, get all your receipts for wedding rings, hotels, etc.

Lots of pictures with the whole family.

Actually, the requirements for the evidence is different, as the two of you are married.

STRONGLY SUGGEST you study the I-130 instructions - there's 6 types of evidence listed there.

Sometimes my language usage seems confusing - please feel free to 'read it twice', just in case !

Note: Evidence of a Bonifide Marriage

The USCIS now requires that when filing an I-130 for a spouse that you include evidence of a bonifide marriage. They list examples of acceptable evidence as:

1. Documentation showing joint ownership or property; or

2. A lease showing joint tenancy of a common residence; or

3. Documentation showing co-mingling of financialresources; or

4. Birth certificate(s) of child(ren) born to you, thepetitioner, and your spouse together; or

5. Affidavits sworn to or affirmed by third parties havingpersonal knowledge of the bona fides of the maritalrelationship (Each affidavit must contain the full nameand address, date and place of birth of the person makingthe affidavit, his or her relationship to the petitioner ofbeneficiary, if any, and complete information and detailsexplaining how the person acquired his or herknowledge of your marriage); or

6. Any other relevant documentation to establish that thereis an ongoing marital union.

Actually, the requirements for the evidence is different, as the two of you are married.

STRONGLY SUGGEST you study the I-130 instructions - there's 6 types of evidence listed there.

ARE THOSE QUOTED ABOVE ATE THE 6 TYPES OF EVIDENCES YOU WERE REFERRING OF? THANKS

As you will have only just been married, and you will still be living in the Philippines, most of your evidence will fall into "6. Any other relevant documentation to establish that there is an ongoing marital union." which will be all the evidence you already have and were planning to show for the K1. You will also want to provide the affidavits from other people. (Item 5.) The first 4 items on the list of evidence for the I-130 are the preferred ones though, so it would be good to provide something from there. You don't have children or live in the same country, so that leaves "3. Documentation showing co-mingling of financial resources." Try to provide something: eg. evidence that you both paid for items relating to the wedding. Also if your fiance can get your name on ANY kind of document in America, for example vehicle insurance.

We went the K3 route because of all the delays in 2007. I would suggest going the CR1 routwe now. Follow the guides until you reach the National Visa Center (NVC). Once your petition reaches the NVC follow the LingChe NVC Shortcut on the VJ Wiki to reduce wait time.

For co-mingling of finances we used money transfer receipts and I was able to convince a local bank to open a combined checking account with a copy of my wife's paasport. I also archived our Yahoo chats and copied all the chat records into a Word Document. Then I copied a few chats over the time period to show the Yahoo user names belonged to us.

Naturalization

3/27/14 - N400 package delivered

4/4/14 - check cashed

04/29/14 - biometrics date

07/01/14 - interview date

I had the same thoughts once upon a time but K3 is lot more EXPENSIVE, takes LOT MORE TIME. In your case, no matter if you have TONS of papers of proofs, the fact that you get married "on the spot" will raise SERIOUS questions as of the seriousness of you too and they will think that both of you were impulive. Who doesn't want his parents to be present at their wedding? We all do, yet we have to be aware too, that there are CONSEQUENCES as well and that there are SACRIFICES we have to make in order to achieve our goals. You guys want to get married on the first date... then face the problems that come with it and to MY opinion they will be VERY serious, up to the point that will put in jeopardy the whole thing.
