K1 VISA: have lived in canada for past 2 years.

Hi,

I am just starting my K1 visa process and want to make sure that my time in canada will not effect the decision. I have duel citizenship and have been studying in Canada completing my university degree for 2 years. I will be graduating in April 2011 and want to move back to the united states and hopefully bring her there at the same time. We met in Canada and lived together for 1 year, but her student visa expired and she left for china. Will this be ok that i have not lived in the US for going on 3 years? I have returned over summer each year. Or is this not a big deal.

Also my fiance always goes by the name Karmilla, which she adopted when she entered Canada. But this name is not on her passport or any legal documents. Will the agency be understanding that many chinese do this? Because on all her phone bills and other proofs of our relationship it will say Karmilla Xu, and i only refer to her in her adopted english name not her chinese name, jiawen.

you will need tax returns or tax transcripts for the last 3 years for the affidavit of support.

She will need a police certificate from canada, since she lived there for more than 6 months, plus her police certificate from china.

Im not sure about the name thing, you may have to file with her legal name and at the interview just tell them its her nick name on the proof documents because they do background checks and if the name doesnt match her passport and birth cert there may be issues with getting the visa. Someone else may know more about the name issue though.
