canada/usa income tax?

Hey Guys n Gals -

Just out of curious...I work in Canada but expect to poe Dec of 2010. I realize i should file income taxes in canada for this year - question if we are married before year ending (2010) - can or will my new husband claim me on his taxes in the us? Will he need to claim my income from Canada? This is confusing! and I thought once we got this far things would be simplified!

Hi. Best to get tax advice from a cross border tax expert, but you definitely should file a joint tax return in the US for 2010.

You won't have to pay taxes again on any of your Canadian income though. There is an old tax thread somewhere in here.

If your Canadian income was while you were in Canada, then you file your Canadian Taxes, not US taxes. However, I was told that if your living in the USA and your getting an income from Canada, i.e. working online, etc...then you would have to file this with USA taxes. Canadian income generated in Canada has nothing to do with your USA taxes

10.19.2012 Check cashed (it never ceases to amaze me how fast the gov't cashes a check!!)

10.29.2012 NOA received dated 10.18.2012

10.29.2012 Biometrics appt received

Canadian income generated in Canada has nothing to do with your USA taxes

Except since they are married that does change things for US tax purposes. You don't necessarily have to "live" in the US to be required to submit a US tax return. There are tax residency rules which have nothing to do with actual residency.

We got married in 2008 but I did not move to the US until 2009. We filed a joint 2008 tax return in the US.

You need your SSN do you not, for someone to claim you?

My husband and I had to show each other on our tax returns for tax year 2009. I had to file for a Canadian Tax ID number, which was easy enough to do. For me to show him on my US taxes as my spouse, I had to file for an Individual Tax ID Number, or an ITIN(because he does not yet have a SSN #). You send the ITIN application in when you file for your regular taxes to a specific address, in Texas I believe.

07-12-2010: E-mailed DS230 package

08-04-2010: Email from NVC - Case Completed

NVC process completed in 71 days

CONSULATE

12-07-2011: Received consulate interview date

12-13-2010: Medical Exam (Medisys)

01-07-2011: Interview - APPROVED!

POE & POST INTERVIEW

01-16-2011: POE Highgate Springs, VT

01-22-2011: SSN Card Received

01-24-2011: Receipt Letter Arrived

02-10-2011: Biometrics Appointment (uncommon for CR-1)

03-15-2011: Welcome Notice Received
