Can This Passport Notation affect Immigration

Hey VJ:

Got a question here. Almost 2 years ago my wife was attempting to come visit me as she had done many times. She was denied entry to the U.S. on the basis of I-275-TOR/PFI 212 (2) )7) ( A ) ( i ) ( I )

From what I understand this basically means she wasn't able to prove strong ties to Canada for her to return to, thus making her an immigrant. Having the wrong Visa to enter the country, since she isn't a tourist. My question is this, will that notation on her passport affect our I-130 approval?

This notation carries no ban.

Any help would be greatly appreciated!

According to INA §212(a)(7)(A)(i), any immigrant who, at the time of application for admission:

who is not in possession of a valid unexpired immigrant visa, reentry permit, border crossing identification card, or other valid entry document required by the Immigration and Nationality Act, and a valid unexpired passport, or other suitable travel document, or document of identity and nationality if such document is required under the INS regulations

As someone who was denied entry twice, as long as it was a simple denial with no misrepresentation, it should be fine as long as it is disclosed on the DS-230 and truthfully explained at the interview

If it will be an issue, it will be at the interview stage. Most denials come at the application process, not at the petition stage
