Can my husband enter the US as a Student then AOS to Spousal Visa? We are already Married

I sincerely don't know why it is judgemental to think that students with an interest in studying in a foreign country should not be discouraged, nay BANNED from staying in that country "on purpose." Any particular reason for thinking that work in said country and a future, settling down and eventual citizenshiop would not be the NATURAL goal of anyone wanting to actually study in that country? I mean a US degree is worth more in the US than it is in the UK, for example. And I wasn't kidding when I said if I went to Japan to study Japanese and gained a degree there, then AOS to work visa would be considered a natural thing, and completely allowed. I was looking at that route before. We're talking a country that let me AOS to a marriage based visa from tourist visa via marriage to a man with work visa (not permanent residence.) And I completely planned to marry him from the get go and told every government employee who asked about the whole plan.

UK doesn't even LET you AOS from tourist, US lets you "if you had no intent." My brain just hurts at these weird attitudes.

Yes I know that, but I'm still allowed to disagree with them and say so. This particular one - "US educated foreigners not welcome to stay" hurts my brain. I know they do it here too, and UK degrees are only 3 years long - quite a few countries don't put much stock in them unless you go to somewhere prestigious. We are sending just graduated doctors back to India et al and consider this a right thing to do, seems like only my brain is screaming from the stupidity of it.

US educated foreigners are definitely welcome in the U.S, if they get a job here after their studies and do the AOS.

But now-a-days, more and more skilled workers (I know many in IT) are going back from the U.S to India since India is offering them good positions.

US educated foreigners are definitely welcome in the U.S, if they get a job here after their studies and do the AOS.

Yet not welcome if they enter study intending to stay on after end of study? Right?

As I say, it doesn't make a lot of sense.

The lady on the TV (indian doctor) was being sent packing. It was a feature on how the NHS need for doctors is in direct conflict with UK immigration law. We are sending home professionals in fields that this country does not produce enough of. I am guessing the USA may be doing similar things.

Yet not welcome if they enter study intending to stay on after end of study? Right? Yes, student visa is non-immigrant visa. They have to move out once the expiry is reached. However, if they get a job in the U.S, they can do Adjustment of Status and live here permanently.

It was a feature on how the NHS need for doctors is in direct conflict with UK immigration law. We are sending home professionals in fields that this country does not produce enough of. I am guessing the USA may be doing similar things. I agree with you. This country (U.S) is lagging to produce skilled workers in many fields. There are many reasons for it.

I hope, by now, you've figured out how to get into the Embassy in London , to drop off yer 'properly filled out' I-130 petition, and have some idea of how to ask for the expedite ?

Thank you Darnell. I appreicate that time is of the uptmost importance here - but I am not in the UK right now. So, I am going to have to fly there for the specific purpose of going to the Embassy and hopping that on the off chance they will expedite our application.

Since this is so important I also wanted to know: in addition to taking in the completed I-130 Application and the relevent Package of documents, and the DS-230 which you have suggested. Should I also have as much else completed as possible, ie the I-864? What else can I do in advance? (we have the police cert, we are waiting on the vaccination history, I've just filed my tax forms for the past three years) We will have to have a joint-sponser, should i have their I-864 form now?
