question about affidavit, just bought a house....

Here is the situation:

Im sponsoring my wife for CR1 visa.

I had about 110.000$ in my bank account and i was told that is enough for affidavit of support.

Now, i bought a house and my account shows only 20.000$.

I still have a recent bank statment showing 110.000$ . Because i just sent my I-130 i guess i will need affidavit of support only in 4-5 months from now,right?

So will they accept my "old" bank statment or thet must be recent one? or i can show even my title for the house? Does it count?

I also have last 3 tax return forms showing i made about 40.000$ each year. Im currently without job!

Well, obviously since that $110K is not still in your bank account you cannot use the old statment which shows you still have it. That would not be truthful to submit the I-864 with a bank statement showing money in your account that you no longer have.

You'll need your tax returns, but you may also need a letter from your employer (we did) showing your job and income is are secure

This should answer your questions...

What can be used as assets? Assets easily convertible to cash can be savings, stocks, bonds and property.

Not having a job may hurt you, you may want to line up a co-sponsor just in case.

My Advice is usually based on "Worst Case Scenario" and what is written in the rules/laws/instructions. That is the way I roll... -Protect your Status - file before your I-94 expires.

Bobby has given you some insight. Let me expand it.

When you prepare your AOS later, here is your scenario.

1) Asset - Bank deposit $20,000 (provide last 12 months statements at that point)

2) Asset - Home's equity $90,000 (need an appraisal from the licensed appraiser)

Total asset $110K. For AOS purpose 33.33% of this value which is around $36,600 will be counted.

If you are jobless this year, may be questionable, but may overcome as well based on the asset. If not, a joint sponser will be needed.
