Submitting i130- MEDICAL EMERGENCY

Hi everyone Ill keep this short and sweet.. My wife went to the gynecologist in Peru a week ago and confirmed that she has a tumor on one of her ovaries. Shes scheduled to have surgery in early October and is very scared, as am I. We would feel a bit more comfortable if she were to have surgery here in the US but as it is she likely wont be able to move here for another 8 or 9 months and it would kill me to see the situation complicated because I asked her to wait and get surgery here. Is there any way to get my i130 expedited on humanitarian or medical grounds? I feel completely helpless. She had another test yesterday which determined that the tumor is solid and about 86x76mm.. Do we have any medically knowledgeable people here? This is like a terrible dream.

You can get the official letter from the doctor in Peru about this issue, but prove that the treatment in the U.S is 'much safer' than doing it in your country, as the ground of expedite. USCIS may approve this case.

Other option is talk to a doctor in your health insurance list in the U.S, consult with him/her and get a letter from this doctor in the U.S that he/she is capable of handling this case in very error free manner. But original letters from the doctor in Peru is also needed.

I guess it depends on whether it's a benign tumor or malignant...once they do the biopsy..if it's benign..non spreading then I dunno..they might not view it as such a big deal..if it's malignant, then I think your chances would increase greatly.

I agree with the above posters. Not only do you have to show how care in the US is drastically different than the care she would be provided in Peru (or show how her life is in danger), you'd have to show how you can pay for the surgery to get around the 'public charge' assumption. Not sure if your current health insureance will cover this or not.

Call the ISO at USCIS, ask all those questions and submit a detailed, informed, well put-together expedite packet

Yes be very aware of the cost implications. I had something similar and had I not had insurance I would have been looking at nearly 40k in bills. They may expect you to show that sort of money in the bank to cover the costs.

This will not be over quickly. You will not enjoy this.
