After K-1 visa is issued...

Hey guys; no, my Canadian fiancee hasn't gotten her visa yet (we will be at 2 months waiting for NOA2 on the 15th)...but my question is: After she does get that visa and crosses the border, when can she return back to Canada? I've heard a year -- does that all depend on whenever I get my SSN / AOS stuff taken care of? Thanks guys - I hope everyone waiting for NOA2 is in good spirits. =)

Timeline

She can leave for Canada any time she wants - she cannot, however, re-enter the US without proper documentation. Once she enters on a K-1 visa, you have to marry and submit the paperwork for her adjustment of status

When you do this, you apply for her advanced parole document, which is used to re-enter the US. This can take 90 days to get after the paperwork has been filed

Hey, thanks! Since I haven't really had the opportunity to pour through all of the AOS paperwork (I am currently on this), I wanted to get a 'feel' for what I was dealing with since we want to have another ceremony in Canada about a year and a half after the wedding that must take place 90 days after the border crossing. Additionally, if some family catastrophe happens, we want to make sure there's a way for her to return, if necessary (flying is not an issue, since my Mother works for the airlines).

'Advanced Parole Document' - I will keep that in mind when I get there and cross that bridge (again, I am still waiting for NOA2 - I'm sort of a heavy planner). She is going to (eventually) have her interview at the Vancouver consulate. Let me ask you: From the time of applying for the SSN to finishing the AOS, how much time do you think will have elapsed? Just wondering!! Thank you so much for taking the time to read and help. How about you? I see that you're a 'Canadian Wife' ? Where did you go! :)

As soon as possible after you marry, you should file for the Adjustment of Status, Advance Parole, and Employment Authorization Document. The processing times for the AOS is 5 months and for the AP and EAD is 3 months. Please note that while she can leave the country any time she wants, in order to re-enter the USA she would need her approved AP. In other words, after you marry you have (potentially and approximately) 3 months where she should really NOT leave the USA if she does not wish to abandon her immigration status adjustment. Hopefully, no emergencies will arise and she should try to leave all Canadian things "squared away" so she does not have to go back soon.

August 23, 2010 - I-129 F package sent via USPS priority mail with delivery confirmation.

August 30, 2010 - Per Department of Homeland Security (DHS) e-mail, petition received and routed to California Service Center for processing. Check cashed. I-797C Notice of Action by mail (NOA 1) - Received date 08/25/2010. Notice date 08/27/2010.

After 150 days of imposed anxious patience...

January 24, 2011 - Per USCIS website, petition approved and notice mailed.

January 31, 2011 - Approval receipt notice (NOA 2) received by mail. Called NVC, given Santo Domingo case number, and informed that petition was sent same day to consulate.

Called Visa Specialist at the Department of State every day for a case update. Informed of interview date on February, 16 2011. Informed that packet was mailed to fiance on February, 15 2011.

February 21, 2011 - Fiance has not yet received packet. Called 1-877-804-5402 (Visa Information Center of the United States Embassy) to request a duplicate packet in person pick-up at the US consulate in Santo Domingo. Packet can be picked-up by fiance on 02/28.

March 1, 2011 - Medical exam completed at Consultorios de Visa in Santo Domingo.

March 9, 2011 at 6 AM - Interview, approved!

March 18, 2011 - POE together. JFK and O'Hare airports. Legal wedding: May 16, 2011.

\Hey, thanks for the helpful information; let me ask this now: Are AOS, Advance Parole, and Employment Authorization 3 separate things? So, I file for all three and then, based on the return time get the Advance Parole and Employment Authorization potentially before AOS is granted? Thanks!!! :)
