My Fiances child is 8 years old. He will follow in about 6-8 months after my fiance is approved. Has anyone been through this process in Peru? Advice to offer? Does the K2 need to be at the K1 interview if following? Does the other parent need to be involved with the process, in what aspect? Will the AOS process be identical for the K1 and K2. I assume this way will be more expensive vs the child coming at the same time. Thanks to all !

you have to have a letter from the other parent stating they give permission for the child to move and they know the child is moving to the USA. Also need court documents stating the parent intending to take the child has full custody or partial custody with the letter. The child MUST have this letter because USA will not let a child travel without it because of child abduction.

I have done two in Ukraine. Basically the same, there may be some minor country specific differences. We needed a permission letter from the father granting permanent permission for the children to relocate to the USA.

The AOS fees are $600 for a child under 14 if filed at the same time as the mother. If filed separately or for a child 14 or older, the fee is the same as the adult. Visa fees are the same regardless.

If the child is following they do not need to be at the K1 interview. They will have their own later. If the child is under a certain age (14 in Kiev) they do not have to interview. Some consulates require ALL children to interview. Some consulates require DNA tests for the children, this can take many months in some cases. Ask the consulate by email for specific K2 requirements.

True more often than not. Some countries do not require this if the parents were not married...such as Phillipines, and others, such as Ukraine and Russia do not require it if the father is not listed on the birth certificate. The vast majority DO require a letter from the "absent parent"

You will need a letter from the child's biological father and it needs to be notarized as well for the child to leave Peru and enter the U.S.. I believe that if you are doing the K1 & K2 at the same time, the child will have to be there for the interview but has 6 months before the visa expires and the child will either have go come to the U.S. or stay in Peru. Hope this helps.
