Hi guys,

My name is Karina and I wanted to ask you guys if I can apply for citizenship already while waiting to be approved for my Removal of Condtions.

1.I will have 3 years of residency in November.

2.I am married to my husband and he is the US Citizen.

3.I applied for the removal of conditions back in Aug. of 2009 and still no decision made.

My case is very rare since I have no updates on the ROC since I applied. I made infopasses and contacted the 1-800 number several times requesting information. I have some inquiry numbers on the investigation of my case meaning they will look at it under "Time Processing is too long".

On the infopass that I had last thursday, the officer said that my case was still under review and to wait a little longer.

What do you guys think? Can I apply for the Citizenship? Will this application of naturalization push my ROC?

Hi,

Yes - you can apply and the ROC will get adjudicated if not approved by then.

N-400 Naturalization Timeline

06/28/11 .. Mailed N-400 package via Priority mail with delivery confirmation

06/30/11 .. Package Delivered to Dallas Lockbox

07/06/11 .. Received e-mail notification of application acceptance

07/06/11 .. Check cashed

07/08/11 .. Received NOA letter

07/29/11 .. Received text/e-mail for biometrics notice

08/03/11 .. Received Biometrics letter - scheduled for 8/24/11

08/04/11 .. Walk-in finger prints done.

08/08/11 .. Received text/e-mail: Placed in line for interview scheduling

09/12/11 .. Received Yellow letter dated 9/7/11

09/13/11 .. Received text/e-mail: Interview scheduled

09/16/11 .. Received interview letter

10/19/11 .. Interview - PASSED

10/20/11 .. Received text/email: Oath scheduled

10/22/11 .. Received OATH letter

11/09/11 .. Oath ceremony

Did you come over as a Cr-1 visa? removal of conditions as in "2 years after you got here"?

I believe your "residency" doesn't count till after you remove your conditions so you would not be able to apply for citizenship till 2012 or so.I am looking for where I saw it.

I take it back ignore me. I guess Ive been seeing things. Yes you can apply and it may push your Aos too! :)

So what happens if I do all the processing for citizenship and passed all the testing and still not approve for my ROC?

They will HAVE TO approve your ROC because you citizenship will be based on your permanent residency so someone will have to go dig up your ROC file and finish/approve it.
