When to give Extreme Hardship

Timeline

Our case is back at Vermont sc after an interview denial of I-129F K3. our I-130 is there as well. Just sent in our evidence they requested, they received it, giving 60 days for their decision (hopefully reapproval).

Assuming (fingers crossed) our I-129f goes quickly through NVC to consulate in New Zealand. He will be interveiwed and of course denied because of overstay and probably some other ####### they will come up with. I will have to file an I-601 at the interveiw.

Now: I NEED to be back here by next summer (LIKE LIFE DEPENDS ON IT).....seriously. If he can't come back by then I have no chance of finishing my training (in another state) from school therefore----> I will have no chance to be granted a working visa to another country to be with him, ever. period. I haven't had a job for over a year because I started full time school for the sole reason to get a working visa elsewhere on this planet that doesn't have a messed up immigration system. I also have documentation that me and my daughter can not live in his country because we tried twice and both times me and my daughter both caught life threatening viruses and had to come back for medical treatment. I don't mind living in a hut with no running water but our bodies' are not immune to what's ever out there.

Any way, I can prove Extreme Hardship, but my question is....do I submit the extreme hardship along with the I-601 at interview. Or prior to the interveiw...if I can submit prior then where do I send it.

Honestly I have a year that I can manage on my own but in immigigration wait time, I don't have a long time. I need to act now.

Sorry me again. I did some research (stupid me) extreme hardship is part of 601. OK...but how am I supposed to WHAT we will be denied for. I'm trying to start a 601 packet to be ready for overstay but what if they find something else. Maybe I'm being paranoid. Also this will be the SECOND interview if I get reaffirmed...I have to wait for the second interveiw? I can't submit it prior?

And I did the K-3 and the I-130 (so far they are taking the same amount of time to be reaffirmed). If I close the K3 then would we still need an interveiw and an I-601 for the CR-1 visa????? :blink: I'm so confused would the I-130 be considered a first interveiw eventhough it was sent to be RE-affirmed from the NVC????

:ot: If I am a born and bred US citizen and I can't under understand the legal immigration process...I feel bad for any immigrant trying to stay here. :(

:ot2: is I-601 still needed for I-130 interveiw and do we have less of a chance if we go with the K-3

My husband needed two waivers. We tried to give them to the consulate when we had our FIRST interview but we learned that they need to determine whether you are even eligible for a waiver. They did tell us that he was eligible and they scheduled another interview where we were to submit the waivers. They told us at the embassy that adjudication of waivers is a long process and to expect to wait another year. Waivers also cost $545.00 each. . You can usually ask someone at the embassy about the adjudification time for waivers.

Also, I hired an immigration attorney to do my paperwork BECAUSE I knew the waiver would be a challenge. My waiver was 4 inches thick. I know I could have never put that package together by myself. Good Luck
