Timeline

Hello all I am in the process of submitting the N-400 for Citizenship. Part 10, A. General Question #4 ask

Since becomming a lawful permanent resident , have you ever failed to file a required Federal, State, or local tax return?

I did not file my 2008 taxes until some time in march 2010 with my 2009 tax return. So in this case do i put yes since i filed late? n or no because i filed at the time i'm filling out the Application?

I might recommend is you get tax transcripts from the IRS and see if there are any indications about your being late. It may be one way to go...

Nonetheless, even if you did indicate that you were late, but you eventually filed them and probably paid a fee or something, so you should be OK to naturalize. If you fail to file and you never correct it, then you have a wrinkle in your path to naturalization.

Hi, may I ask you what did you eventually write on your application? Yes, or No? I am in a similar situation, I filed late, but nevertheless, at present I am up to date with everything. Technically, I am inclined to say "No", because I did not "fail", I was just late.

K-1 petition

February 6th 2007 - K1 petition sent to TSC

February 16th 2007 - cheque cashed

February 22nd 2007 - NOA1 received by mail!

May 16th - received NOA2 hardcopy

May 25th - first set of documents received home in Bucharest (list of documents to present at the interview) - based on fiance's request to open a provisional file

May 30th - packet arrived at the Embassy, Embassy notifies us about it.

June 21st - interview APPROVED!

June 22nd - VISA

August 17th - arriving in USA, through JFK

Sept 8th - wedding :)

Nov. 14th 2007 - delivered in Chicago

Dec. 18th 2007 - NOA for AOS, EAD, AP

Jan. 08th 2008 - Biometrics

Jan 09th 2008 - Transferred to CSC

Jan 09th 2008 - AP approved, EAD card production ordered

Jan 16th 2008 - AP in mail

Jan 19th 2008 - EAD in mail!!!

Jan 24th 2008 - AOS touch

Feb 05th 2008 - AOS touch

Feb 06th 2008 - AOS touch - RFE sent out

March 7th 2008 - Sent response to RFE (new medical)

March 28th 2008 - CRIS e-mail: CARD PRODUCTION ORDERED

April 4th 2008 - GREEN CARD RECEIVED

Part 10. Section A, question # 4 I "No"

While I did not file at the time of the interview and case submission I was current. I simply provided the information for the requested years. I also owed taxed for the year in question and when I did eventually filed.. It "caused" question # 5 to br "no" as well because my taxes are current. I'm a US.Citizen today.

I do not know about a question that asks you when you filed, or how, you filed, or if you filed late.

I only know about a question that asks you if you ever failed to file. The purpose of this question is to establish if you are on good terms with the IRS. So if you have filed your tax returns for 2008, for 2009, and for 2010, and you can prove it by submitting tax transcripts for all 3 years, you clearly have not failed to file taxes.

I do not know about a question that asks you when you filed, or how, you filed, or if you filed late.

I only know about a question that asks you if you ever failed to file. The purpose of this question is to establish if you are on good terms with the IRS. So if you have filed your tax returns for 2008, for 2009, and for 2010, and you can prove it by submitting tax transcripts for all 3 years, you clearly have not failed to file taxes.

USCIS sure wanted to see our tax returns for my wife for the three year, didn't even want to peek at them for my stepdaughter for the five year. Not even required as evidence for the five year.

But you still have to answer that question either way, would think if the IRS is not auctioning off your property, garnishing your wages, or putting you in jail. You would be on good terms with them and could answer no to this question. They are really tough on individuals, even if you only owe them a buck. Was much better in my corporate days, no fear of the IRS. We had a staff of tax attorneys, and they didn't want to deal with those. Could write off millions without question.

Its the same with the DMV, if you don't pay that traffic or parking ticket fine, will send the police over and take your drivers' license and license plates. And the only way to get those back is not only to pay your fine, but a super stiff fine besides.
