Help I130 Submission

Hi.

My wife and I were wed in the Ukraine in early March. We've been living together in various locations including a brief two month stay in Germany. We recently decided that we'd like to go back to the States.

03/2010 - 07/2010 - Odessa

07/2010 - 08/2010 - Munich

08/2010 - Present - Odessa

Now, we prepared the entire I-130 packet and shipped it off to Moscow's USCIS by the recommendation of an immigration attorney. Mistake #1.

They're returning it now and we're looking at where we need to submit it.

Technically, I have not been living in the Ukraine continuously for the past six months. I also haven't been back to the States since my wedding.

We are desperately hoping to submit the I-130 to Kiev, I have a three (3) year visa to the Ukraine. Will this be enough to please the Consulate?

Does anyone have prior experience with this consulate? What can I expect?

If not, which USCIS center am I to send the packet to?

If you stay in Ukraine for 6 months from now and have domicile in the U.S, you can file DCF (Direct Consular Filing at the Consulate) over there.

Otherwise, return to the U.S and send your I-130 petition to Chicago Lock box, they will re-direct it to the appropriate Service Center here.

05/07/2012 - I-864 AOS package received by NVC

05/07/2012 - DS-3032 COA accepted

05/08/2012 - DS-230 IV Fee $230*2 paid

05/09/2012 - DS-230 IV package mailed to NVC

05/11/2012 - DS-230 IV package received by NVC

05/17/2012 - Case Completed

07/02/2012 - VFS visit in Cochin

07/04/2012 - Medical in Chennai

07/12/2012 - Interview in Mumbai - Success!

09/08/2012 - POE at JFK, NY

IMO, if yer 'residence' is in Ukraine, then those 2 months of out country are OK - but check with a Consular Officer (US Citizen) to be certain - do not waste any time with the local Ukranian workers there, at all.

If a ConOff tells you 'not yet', then

IMO - stay in Odessa, wait it out - as

it's much faster, even with the waiting,

than to file the I-130 to Chicago Lockbox.

Yes. DCF is absolutely the bestest. fastest, cheapest way to bring your wife here. You have to have been living in Ukraine for 6 months. The 2 months in Munich should not count against you, IF you maintained an address and "official" residency in Ukraine. I agree with Darnell. Wait it out 2 months if necessary
