After reading all the threads on K3 vs. CRI I'm convinced 100% that the only circumstance why anyone would/should choose a K3 at this point and if made available, would be limited to those husband/wife wishing to live or work overseas AND wanting the privilege to visit the United States during the processing period.

The couple could take advantage of the K3 multiple entry visa and wait 'til the two year mark and then pursue the IR1 visa and subsequently be granted a 10 yr. GC. AND ALSO SAVE ON THE $1010 FOR ADJUSTMENT OF STATUS AND LIFTING OF CONDITIONS LATER.

Outside of this situation, the processing time for both K3 and CR1 are comparable. For most couples, the CR1 is the ideal visa.

Lets take couple of scenarios - 1) if K3 gets approved at same time with CR/IR-1, NVC will close K3, and proceed with CR/IR-1. This is to avoid multiple visas and further delay in duplicates.

Thank you for the info, Jimmy! :thumbs: But my situation is out of any category since the NVC is proceeding with the CR/IR1 as we requested and at the same time the Embassy sends me a letter for the K3... And on top of everything, the operator at the NVC told us on Friday that when they receive both I-130 and I-129F (approved at the same time, like in our case) they close the nonimmigrant petition, BUT NOT ALWAYS!!! :unsure: (Yeah, that's exactly what it says in their regulations: Effective Feb 1st bla-bla-bla CLOSE THE K3 (but not always) bla-bla-bla) :angry: Hopefully, tomorrow we'll get things cleared so we can continue the journey! :) *prays*

@SPSguy : I couldn't agree more!!! But hubby insisted on filing for K3 also back in April and my opinion didn't count then... Off course, now I have the pleasure of rubbing it in at least twice every day... HA! :devil:

OK, so...

I talked to a person at the USE in Sofia today and the guy told me THAT: even if they have received the K3 petition first, once they receive the CR/IR1 they "upgrade" the nonimmigrant to an immigrant visa aplication, so we got a "green light" for the payments and no worries anymore for us (at least on this matter)!

We paid the AOS&IV fees and now we are back on track with NVC! :star:

I hope no one has to go trough this and wish everyone good luck!

I was curious though, if you got an interview letter for K-3 from the USE why didn't you just go for it? Other than avoiding the cost of AOS, being able to work in the US etc., was there a reason for your husband NOT to take the K-3? Wouldn't he be able to join you in the US sooner?

@missads: You got it backwards, hun! :P I AM the beneficiary and hubby is the petitioner! :) And he did want to go for it but after we talked it over (did the + and - thingy) we decided to stay on the CR/IR1 path... We didn't go with the K3 because it is pointless and this stage - we already had the bills for the immigrant visa :) So we are half way trough NVC (hopefully no RFE's) :)

That's if you think being able to come to the US 2 months earlier is "pointless".

Unfortunately "half way through NVC" you still have a long way to go. We paid our IV fee at the end of July and eventually got an interview date of October 5th, without any RFE, without wasting any time sending our documents back.

So, I would have asked the embassy when the interview for the K3 would be.

Maybe cos my English skills are so good and I even correct hubby sometimes (and he hates me for it) HAHAHA :devil: Just kidding... ;)

If the K3 had worked like it is supposed to - faster than the CR/IR1 (like June :D) - then we would have deff. gone for it. But since both petitions are approved at the same time I really don't see the point in it. I mean, yeah - 2 or 3 months more is quite a while but it IS better to get the GC, right? :) Besides, it only took 2 weeks from USCIS approval to receive a letter for the interview! :) So i guess not a lot of ppl from BG are waiting for a visa! :D

And I really hope the expedition request is approved! :innocent:
