Permission from biological father?

1. Do I need the permission document for a minor stepchild to immigrate to the US for NVC or interview only?

2. My wife was never married but the father is listed on the BC do we still need the permission document? This father is less then willing to cooperate and is a bit dangerous for our approach. We have a legal document "Permiso de Salida de personas Menores de Edad" This states the minor child can travel out of the country with either the mother or father but does not state to Immigrate permanently.

3. There are two children one of the kids BC has no father listed on the BC and she was never married but we have contact with the father. Do we need the permission from this father as he is not listed on the BC?

We are CR1 and embassy is Costa Rica.

Yes you need permission to immigrate, not simply to travel, from the father

No real way around this.

NVC doesn't mandate this document in their checklist. You 'may' produce it to the Consulate.

I am not sure about if the father is NOT listed on BC. Contact your consulate about this issue by email. Follow what they advise and keep a copy of Consulate's response as a proof as well.

Technically, you need the "sole physical custody" of the child in the "divorce decree" or "court order" or "executed by the other parent legally", to take the child anywhere in the world.

In Philippines as per our family code, children out of wedlock are on the sole custody of the mother. Please check the family code in Costa Rica since you have mentioned your wife was not married to the father of the kids.

Yes. Wife did not have sole custoday of the child. We obtained a notarized statement (and notarized translation of same) from the father (ex-husband) which specifically approves the immigration of the daughter to the USA.

I doesn't depend on NVC or any consulate opinion. Firstly You need to know Costa Rica's Law, because based on that is when you will know what to do soo Costa Rica´s government allow you to travel with a Child.

In most of the countries, you need an specific document signed and registered in the proper office, and only with this you are authorized to travel with a child. No matter if you are the mother, or if the child is in BC in any consular office. Those laws were made with the main intention to protect

the child from abusive behavior

I finaly received a email from the consulate in CR 3 weeks later... The email states for child #1 we will need a signed letter from the biological father wich by the way we did locate him and he signed in the lawyers office in CR...Thank god thats done.

For child #2 due to the fact that the biological father is not listed on the BC we do NOT need permission from him.

So I think I'm done with this part of the document gathering... And I hope this helps someone else in the same situation.
