Hi mga kababayan I really need your help on this one!

My bf/fiance (American citizen) and I are wanting to file for I-129F now that his divorce has finally come through.

And would like to get your advice on our application.

I met my fiance for the first time when I was in the States to visit friends(June of this year). He was going through a divorce during that time and we started dating each other while the divorce proceedings was going on. Of course now applying for K1 he is already divorce. But I just meant the time we met he was still going through one, would that be a problem?

All our hotel documents and receipts was paid by him and has proof that I stayed with him and him with me through all the 2 months I was in his State..But like I said he was still going through a divorce then and his divorce certificate would show that it (the divorce) got done after the time we met and started dating. Would that be okay or would that be a problem?

He is planning to come to the Philippines so we can see each other again, do you think we should wait to file for I-129 after he visits? We just want to file now because we heard it takes a long time and we want to be together ASAP.

How long on average does the entire process of K1 take?

Another problem is question 18 on the 129F form, how you met your fiance?

Can the answer be short like "We met when she visited the States, we started dating and we lived together for 2 months and then she went back home"?

And some people here say to attach timeline of relationship is that important? Do we include the very first time we knew each other since we met 3 years ago on an online gaming site?

Sis for the affidavit of support I-134 do they follow the poverty guidelines because on his income tax return, he is self-employed and given tax brakes for expenses made on the business by the government, it comes out less than what he really earns and does not make the cut? Would that be okay? Line 22 on his 1020 form.

Thank you for your help mga sis and bros!

You just need to prove you met during the last two years. That is it. So a picture together,,, and tickets proving you were in the same city

at the same tie would be enough. I would file as soon as possible if you are sure he is the one. It does take 6 to 9 months for processing,

the sooner you file,,, the quicker you will have a visa in hand.

As far as a divorce pending,,, divorces sometimes take a long time,,, and it is common for people to separate for a long time before divorce is

filed for, let along processing completed. This should not pose a red flag. just be prepared to explain it if asked.

Good luck... The journey is long, but, worth it.

Thank you we will file ASAP. We just thought that with us meeting during his divorce proceedings and dating before it was finalize would cause a red flag.

I do have tickets and pictures stating I was in the same state as him and that we stayed together or lived together in an apartment/hotel since the registration was both in our names. And have receipts under his credit card that proved he paid for the hotel/apartment. That would be enough, right? And DEFINATELY YES he is the one. He has been the one for a very long time hehehehe!

The journey does seem very long. Right now it is very hard to be so far apart. Thanks for your help and advice. We really appreciate it. We are both clueless with this. :)

Hi peeps! Follow up question if anyone can help or know something about it.

My fiance as mentioned has just been recently divorced so his 1020 or income tax return for 2009, 2008, 2007 was filed jointly with his ex i.e like combined income since he was married then? Would that be a problem? He does make the cut off for the poverty guideliness even with his ex and kids and me included.

Not a problem. Make sure it is complete enough to show his individual income, whether business or wages/salary/armed robbery etc.
