Permanent resident card never received

My wife entered the US from China in December 2009 and according to USCIS they sent out her permanent resident card in Feb 2010, but they had a typo on our address so she never received it. But when we filed for a new I-90 stating that we never received the card, they denied the application after 4 months. They said that since no card was ever returned to them as undelivered, they rejected the application. We think the post office either lost it or just delivered to the wrong address and someone just tossed it out.

What can we do now? Can we reapply using the I-90 and this time say it was lost? Would the USCIS consider the application knowing that previously we filed it as never received? Also can my wife get her I-551 stamp renewed in the mean time in order to use that as a temporary evidence of permanent residency? Please help!!

I suggest you go to local uscis office, as result of obtaining an infopass appointment, you two go together,

and talk face to face with uscis human. Bring something 'official looking' with your current address, and have the uscis human review what's stored in the computer. They will have a record of when it went out, also if it was returned by USPS, but - your bottom line should be -

USCIS never had the right address, was mis-key on data input by a federal worker, and you want the green card issued to the proper address.

the I-551 stamp should have a validity of 1 year from POE date, yes?

If they had a typo in your address then it was their fault she never received her green card, not yours. Don't give in and freely pay for a new card without a fight because they've already taken enough money from you already. Go to your infopass appointment and explain what happened with evidence to back up your claim and at the same time try to get your wife's passport stamped with the I-551 which shouldn't be a problem.

That's what happened to me too - 6 months after POE nothing received. USCIS Infopass was useless as the lady there told us "it happens all the time" and to file I-90 with fee marking that we lost or mutilated the card which was never received. We never moved and they had the correct address so the burden was now on them as we checked with the post office and no letters addressed to me were returned and I received probably 3-4 Welcome letters from USCIS.

We involved our congressman and after two filings - one was returned asking for payment after which I emailed our immigration case worker who got email from the TSC with specific instructions what to write on the front of the envelope (someone's name plus don't open in mail room) we received the green card - one month shy of 1st POE anniversary.

We did pose specific questions for congressman and TSC USCIS director - proof they actually produced the card (none available), proof they mailed the card (none available) to which we never received the answers...

my thoughts to you: stand your ground and DON'T pay new I-90 fee. Involve your representative and get that green card.

Thank you all for your advice. I think i will go to the local USCIS office and see what they can do. In addition, I will write to my Congressman. I've made an infopass appointment for this Wednesday morning, so hopefully all goes well.
